What Florida law actually shifts when you use a PEO

  • Workers compensation thresholds are lower than people expect. Fla. Stat. section 440.02(20)(b)2 requires coverage for all private employment with four or more employees, and for all private employment in the construction industry with one or more. Full-time and part-time employees both count, and the Florida Division of Workers Compensation states that coverage is required regardless of whether the employee works at the employer’s physical location or remotely. Agriculture is six or more regular employees and twelve or more seasonal employees working 30 or more days. Contractors carry an extra duty: under Fla. Stat. section 440.10(1)(g) they must verify that every subcontractor complies before the subcontractor starts work.
  • Officer exemptions are capped, and the cap differs by industry. Under Fla. Stat. section 440.05, a construction corporation or affiliated group may exempt a maximum of three corporate officers, each holding at least 10% ownership, at a $50 fee each; a construction LLC is likewise capped at three members. Non-construction employers face no limit on exempt corporate officers and no fee, and may exempt up to ten LLC members. Since 1 January 2023 every applicant must view the Division’s online tutorial and attest to it. An officer who elects exemption cannot recover benefits.
  • A PEO is an employer for workers compensation but not automatically for E-Verify. Fla. Stat. section 440.02(19)(a) treats employee leasing companies and employment agencies that supply their own employees as employers. But Fla. Stat. section 448.095(2)(f) provides that where a written agreement places the primary E-Verify obligation on the client company, the leasing company need not verify. Whether your PEO carries that duty is a contract question, not a statutory one, and it is worth reading before you assume it has moved.
  • Out-of-state coverage does not travel far. An out-of-state employer working in Florida needs a Florida policy or a Florida 3.A. endorsement. Extraterritorial reciprocity is limited to 10 consecutive days or 25 total days in a calendar year.
