What New York rules do to a software stack

  • The audit obligation is yours, not the vendor’s. Local Law 144 of 2021, Administrative Code sections 20-870 to 20-874, effective 1 January 2023 with enforcement from 5 July 2023, requires a bias audit within one year of use of any automated employment decision tool, conducted by an independent auditor – someone who does not work for the employer or the vendor, has no financial interest in either, and had no prior involvement in developing or using the tool. The audit calculates selection or scoring rates and impact ratios across sex categories, race and ethnicity categories, and intersectional categories. A summary must be published on the employer’s website or by hyperlink, including the audit date, the data source, the number of individuals assessed, applicant counts, selection rates and impact ratios. A vendor’s own published audit does not discharge your duty, and a vendor’s refusal to supply the underlying data is a procurement problem you need to solve before signature, not after.
  • Ten business days’ notice, and daily accrual. Candidates must be notified at least 10 business days before the tool is used, by job posting, email, mail or website, identifying the job qualifications and characteristics the tool assesses and allowing a request for an alternative selection process or accommodation. Penalties are “not more than $500 for a first violation and each additional violation occurring on the same day as the first violation, and not less than $500 nor more than $1,500 for each subsequent violation” – with “each day on which an automated employment decision tool is used in violation” giving rise to a separate violation, and each failure to give notice a separate violation again.
  • Records outlast the software. Labor Law section 195(4) requires payroll records “established, maintained and preserved for not less than six years”, and the signed section 195(1) hiring notice acknowledgment – in English and the employee’s identified primary language – for the same six years. New York City training records under Local Law 96 are kept at least three years with a signed acknowledgment. Six years is longer than most SaaS contracts and considerably longer than most migrations, so export and archive have to be designed in rather than negotiated at renewal.
  • And leave accounting needs two buckets and a three-day report. Labor Law section 196-b accrues at not less than one hour per 30 hours worked to 40 paid hours at five to 99 employees or 56 at 100 or more, carrying over, with minimum increments capped at four hours. Since 22 February 2026, New York City Local Law 145 of 2025 adds 32 hours of immediately-available unpaid protected time off granted on the first day of work and each calendar year, which do not carry over. Section 196-b(11) requires accrued and used amounts to be produced within three business days of an oral or written request.
