Hillsborough County Code ch. 51, adopted as Ord. 15-25 on 21 October 2015, is broader than the equivalent ordinances elsewhere in Florida. It covers employees who perform work benefiting an employer located within Hillsborough County even though they are remotely located outside it, and it extends expressly to independent contractors. Claims open at $60 in unpaid wages and the ordinance presumes payment is due within 14 calendar days of the work performed unless the employer has established, by policy or practice, a consistently applied recurring pay schedule. It applies inside Tampa city limits with no city opt-out. A time and pay system scoped to Florida-resident W-2 staff will not produce the records this ordinance contemplates.
  • Retention windows are set by the limitation periods, not by your platform’s defaults. Florida Minimum Wage Act claims under Fla. Stat. section 448.110 carry a four-year statute of limitations, five years where the violation is willful. E-Verify documentation must be retained three years under Fla. Stat. section 448.095.
