What Broward County can and cannot require of a benefits plan

  • Local benefit mandates are preempted outright. Fla. Stat. section 218.077(2)(a) bars any political subdivision from establishing, mandating, maintaining or requiring an employer to pay a minimum wage other than the state or federal rate, or from requiring employment benefits not otherwise required by state or federal law. Section 218.077(1)(d) defines employment benefits to include paid or unpaid days off for holidays, sick leave, vacation and personal necessity. That is the whole reason no Broward County or City of Fort Lauderdale paid sick leave or PTO ordinance exists, and why neither can now enact one.
  • Broward’s one local wage requirement reaches contractors, not employers generally – and it has an expiry date. Broward County Code ch. 26, Article VII imposes a living wage on service contractors with county contracts above $100,000 and on airport concessions. It has never bound private employers at large. Section 3 of ch. 2024-80 (CS/CS/HB 433) preserves such local terms only in contracts entered into before 30 September 2026; from that date Fla. Stat. section 218.077(2)(b) and (c) bar the county from using its purchasing or contracting procedures to control contractor wages at all. We do not publish Broward’s current living wage rate – the county rate for 2026 is not something we have been able to confirm from a primary source, and a benefits budget should not be built on a figure taken from a secondary listing.
  • The state floor moves on the same day. Florida’s minimum wage rises from $14.00 to $15.00 on 30 September 2026 under Fla. Const. Art. X, section 24(c), self-executing and requiring no agency action, with the tipped direct cash wage moving from $10.98 to $11.98 against a tip credit frozen at $3.02. For a benefits administrator the consequence is affordability testing, not payroll: raising the wage floor changes the employee contribution as a percentage of pay for the lowest-paid tier of the plan.
  • Domestic violence leave is the one benefit Florida does mandate, and it is state-level. Fla. Stat. section 741.313 applies to employers with 50 or more employees, giving employees with at least three months of service up to three working days of leave per 12-month period, paid or unpaid at the employer’s discretion, after exhausting other accrued leave unless waived. Section 218.077(3)(b) puts domestic violence ordinances outside the preemption, so a county could go further – only Miami-Dade has. Broward has no domestic violence leave ordinance, and it would be wrong to administer one here.

Retail employed 105,815 people in Broward County at an average weekly wage of $964 in the fourth quarter of 2025 – the only one of Florida’s four large metropolitan counties where retail, rather than health care, is the biggest private employer. Accommodation and food services employed 83,788 (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026).
  • Those two sectors together are roughly 190,000 Broward jobs at wages far below the county average weekly wage of $1,532, which is itself 2.4% below the national $1,569. Benefits design in Broward is a participation and affordability problem before it is a plan selection problem, and more so than in Miami-Dade, where the county average weekly wage is $1,659.
  • Benefits expertise is thin across the MSA. Compensation, benefits and job analysis specialists (SOC 13-1141) numbered 1,670 across the Miami-Fort Lauderdale-West Palm Beach MSA at a location quotient of 0.82 and an annual mean of $73,370 against a national mean of $84,330 – a discount of 13.0%, the largest of any HR occupation in the MSA (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026).
  • The market is contracting. The Fort Lauderdale-Pompano Beach-Sunrise metropolitan division recorded 908,200 nonfarm jobs in July 2026, down 400 over the year on a not-seasonally-adjusted basis and down 3,400 (0.4%) seasonally adjusted – one of only two of Florida’s 25 metropolitan areas to lose jobs over the year (FloridaCommerce preliminary July 2026 figures, released 21 August 2026). Broward County employment also fell 0.5% in the QCEW year to December 2025.
