What actually changes in Florida when leadership changes

  • An officer exemption is personal and capped. Under Fla. Stat. section 440.05 a corporate officer or LLC member may elect exemption from workers compensation coverage by Certificate of Election to be Exempt, but the certificate attaches to the individual, not the seat. A construction corporation or affiliated group may exempt a maximum of three officers, each holding at least 10% ownership, at a $50 fee each, and a construction LLC is likewise capped at three members; non-construction employers have no cap on corporate officers and no fee, and may exempt up to ten LLC members. Since 1 January 2023 every applicant must view the Division of Workers Compensation’s online tutorial and attest to it. An exempt officer cannot claim benefits. When an exempt officer departs and a successor takes the seat, the successor is covered unless and until they file their own election – and in construction, where the coverage threshold is one employee under Fla. Stat. section 440.02(20)(b)2, that gap matters immediately.
  • Retention instruments changed on 1 July 2025. The Florida CHOICE Act, ch. 2025-213 creating Fla. Stat. sections 542.41 to 542.45, permits a covered garden leave agreement requiring up to four years of advance notice of resignation, with full salary and benefits continuing and no work required after the first 90 days, and covered noncompete agreements of up to four years reduced day for day by any non-working notice served. On application a court must grant a preliminary injunction, rebuttable by the employee only by clear and convincing evidence. The covered-employee test keys to twice the annual mean wage of the relevant Florida county; we do not publish a figure for Broward County, because no primary source publishes county annual mean wages in the form the statute references. Health care practitioners as defined in Fla. Stat. section 456.001 are excluded.
  • The exposure tail is longer here than elsewhere in Florida. Broward County Code ch. 16.5 gives a complainant one year to file, where Miami-Dade, Hillsborough, the City of Tampa and Palm Beach County all use 180 days. The Florida Civil Rights Act allows 365 days to the Florida Commission on Human Relations, and since ch. 2026-116 (approved 22 May 2026, effective 1 July 2026) a civil action must be brought within one year of the earlier of an FCHR cause determination or an EEOC right-to-sue notice, or within 18 months of the complaint if neither issues inside 180 days. A leadership change made today is contestable well into 2028.

  • That transportation and utilities collapse is the single sharpest sectoral move in any Florida metropolitan area this year, and it sits in Broward’s largest supersector. A leader taking over a Broward business is inheriting a contracting market with one growing sector, which is a materially different succession problem from taking over a growing one.
  • Unemployment in the division was 4.6% in July 2026 against 3.9% a year earlier, on a labour force of 1,067,539.
