What California actually requires, and at what size

  • Training is mandatory from five employees. Government Code section 12950.1(h)(1) applies to “any person regularly employing five or more persons or regularly receiving the services of five or more persons providing services pursuant to a contract.” Supervisory employees need at least two hours of classroom or other effective interactive training and non-supervisory employees at least one hour, once every two years – within six months of hire, or within six months of assuming a supervisory position. Seasonal and temporary employees hired for fewer than six months must be trained within 30 calendar days after hire or within 100 hours worked, whichever comes first, and for temp-agency workers the temporary services employer trains, not the client.
  • The content is specified. Federal and state law on the prohibition, prevention and correction of sexual harassment; available remedies; practical examples on preventing harassment, discrimination and retaliation; delivery by trainers with relevant expertise. Section 12950.1(a)(2) adds prevention of abusive conduct and section 12950.1(a)(3) requires coverage of harassment based on gender identity, gender expression and sexual orientation, with practical examples. The Civil Rights Department publishes free one-hour and two-hour courses, and employers using them are deemed compliant.
  • And a separate, larger duty sits behind it. Government Code section 12940(k) makes it unlawful for an employer to fail “to take all reasonable steps necessary to prevent discrimination and harassment from occurring.” Compliance with the training requirement does not insulate an employer from harassment liability (section 12950.1(c)), and a claim that training did not reach a particular individual does not by itself create liability – so training is necessary and not sufficient. Note also that while FEHA generally applies at five employees, harassment reaches “any person regularly employing one or more persons” under section 12940(j)(4)(A).
  • The exposure the training controls. FEHA’s protected characteristics under section 12940(a) include race, religious creed, colour, national origin, ancestry, physical and mental disability, reproductive health decisionmaking, medical condition, genetic information, marital status, sex, gender, gender identity, gender expression, age, sexual orientation and veteran or military status. Filing runs three years to the Civil Rights Department under section 12960(e)(5), then one year to sue from the right-to-sue notice, and there is no statutory cap on damages under section 12965(d), with expert witness fees recoverable by a prevailing plaintiff.
