The California five-employee cliff, and the three that start at one

  • Five employees brings five separate obligations at once. FEHA applies to “any person regularly employing five or more persons” (Government Code section 12926(d)). CFRA applies at five under section 12945.2(b)(4)(A), giving up to 12 workweeks to employees with more than 12 months and at least 1,250 hours of service – with a family definition covering child, parent, grandparent, grandchild, sibling, spouse, domestic partner and a designated person, which federal FMLA does not. Bereavement leave under section 12945.7 gives up to five days on the death of a family member including a parent-in-law, for employees with 30 days’ service, to be completed within three months. Reproductive loss leave under section 12945.6 gives up to five days following a failed adoption, failed surrogacy, miscarriage, stillbirth or unsuccessful assisted reproduction, capped at 20 days in a 12-month period. And harassment prevention training under section 12950.1 requires two hours for supervisors and one hour for everyone else, every two years.
  • Three start at one employee, or at none at all. Harassment liability under FEHA reaches “any person regularly employing one or more persons” (section 12940(j)(4)(A)). Paid sick leave under Labor Code section 246 has no size threshold: one hour per 30 hours worked, usable from the 90th day, a 40-hour or 5-day annual use cap, mandatory carryover, and an accrual cap the employer need not exceed of 80 hours or 10 days. Workplace violence prevention under Labor Code section 6401.9, operative since 1 July 2024, applies to all employers, employees and places of employment, requiring a written plan that is available and easily accessible at all times and specific to the hazards of each work area – with a narrow exemption for places of employment with fewer than 10 employees present at any given time that are not accessible to the public, and for employees teleworking from a location of their own choosing.
  • And FEHA’s own duty is affirmative. Section 12940(k) makes it unlawful to fail “to take all reasonable steps necessary to prevent discrimination and harassment from occurring.” That is an operational obligation measured by what the organisation actually did, and it is the one a five-person company is least equipped to evidence. Filing runs three years to the Civil Rights Department under section 12960(e)(5), then one year to sue after a right-to-sue notice, with no statutory cap on damages under section 12965(d).
  • Locally, San Diego adds two more. The citywide minimum wage of $17.75 from 1 January 2026 covers any employee performing at least two hours of work in a calendar week within city boundaries, and the city’s Earned Sick Leave ordinance applies an 80-hour accrual cap with mandatory carryover on top of the state rule.

  • That 7% premium is the smallest in coastal California by a wide margin. San Francisco-Oakland-Fremont pays HR managers $219,270 – about 1.34 times national – and San Jose $257,750, about 1.57 times. San Diego is where California HR leadership is most affordable, which is precisely why the build-versus-buy calculation is closer here than in the Bay Area.
  • But it is still $176,250. A San Diego company with 8 or 25 employees has crossed FEHA, CFRA, bereavement, reproductive loss, training, paid sick leave and workplace violence prevention, and cannot justify that salary. Compensation and benefits managers number just 240 across the whole metro at $163,260 – effectively national parity, and the only near-parity figure in California’s coastal metros.
