The California payroll rules that carry the penalties
- Final pay is immediate on discharge. Labor Code section 201(a) makes wages earned and unpaid “due and payable immediately” when an employee is discharged, including on layoff. Section 202(a) gives 72 hours where an employee quits without notice, and requires payment at the time of quitting where at least 72 hours’ notice was given; where the employee requests payment by mail, the date of mailing is the date of payment.
- Waiting time penalties run for up to thirty days. Labor Code section 203(a) provides that where an employer willfully fails to pay in accordance with sections 201 and 202, “the wages of the employee shall continue as a penalty from the due date thereof at the same rate until paid or until an action therefor is commenced; but the wages shall not continue for more than 30 days.” For a salaried employee that is a substantial number attached to a single missed deadline.
- Nine items on every wage statement, and a $4,000 ceiling on private penalties. Labor Code section 226(a) requires gross wages earned; total hours worked; piece-rate units and rates where applicable; all deductions; net wages; the inclusive dates of the pay period; the employee’s name and only the last four digits of the social security number or an alternative identifier; the name and address of the legal entity that is the employer; and all applicable hourly rates in effect during the pay period with the corresponding hours worked at each rate. Records must be kept at least three years. Section 226(e)(1) gives an employee suffering injury from a knowing and intentional failure the greater of actual damages or $50 for the initial pay period and $100 per employee for each subsequent violation, capped at $4,000, plus costs and fees. Section 226(c) requires the employer to produce records within 21 calendar days of a request, with a $750 penalty for failure under section 226(f). Labor Commissioner citations under section 226.3 run to $250 per employee per violation on an initial citation and $1,000 on a subsequent one.
- And the PAGA calculus changed in 2024. For actions brought on or after 19 June 2024, Labor Code section 2699(f)(2)(A) sets a default civil penalty of $100 per aggrieved employee per pay period, reduced to $25 for derivative wage-statement violations where the employee could promptly and easily determine the accurate information from the statement alone, and $50 for an isolated, non-recurring event not extending beyond the lesser of 30 consecutive days or four consecutive pay periods. Critically, section 2699(g)(1) caps recovery at 15% where the employer took all reasonable steps to comply before receiving notice, and section 2699(h)(1) at 30% where it did so within 60 days after. “All reasonable steps” is defined non-exhaustively to include periodic payroll audits and action on the results, disseminating lawful written policies, and training supervisors. Section 2699(o) halves the penalty where the pay period is weekly.
