What New York requires of a variable pay plan

  • The city rule needs a floor and a ceiling. Local Law 32 of 2022, effective 1 November 2022, requires any advertisement for a job, promotion or transfer performed wholly or partly in New York City to state both a minimum and a maximum that the employer “in good faith believe[s] at the time of the posting they are willing to pay.” Open-ended formulations – “$15 per hour and up” – are non-compliant. “Salary” means base hourly or annual wage only: benefits, paid time off, retirement contributions, severance, overtime, commissions, bonuses and equity need not be listed. The threshold is four or more employees, or one or more domestic workers, with owners and individual employers counting toward the four; employment agencies are covered regardless of size. An “advertisement” includes internal postings, online listings, printed flyers and newspaper ads, and covers full-time, part-time, interns and independent contractors.
  • State law adds the job description, and covers roles that report into New York. Labor Law section 194-b, effective 17 September 2023, applies at four or more employees and requires disclosure of the compensation or range and the job description, if such description exists. Its scope reaches any opportunity performed at least in part in New York “including a job, promotion, or transfer opportunity that will physically be performed outside of New York but reports to a supervisor, office, or other work site in New York” – so a fully remote out-of-state sales role reporting to a Queens manager is covered. For commission-only roles the state rule permits “a general statement that compensation shall be based on commission.” Temporary help firms are excluded; employment agencies and recruiters are not. Section 194-b(7) preserves the stricter city rule alongside it.
  • The penalty structures are very different. State civil penalties under Labor Law section 218 run to $1,000 for a first violation, $2,000 for a second and $3,000 for a third or subsequent. The city imposes no civil penalty for a first violation cured within 30 days of notice – but uncured or subsequent violations carry penalties up to $250,000. A quota-and-accelerator plan advertised without a defensible base range is exposed to the larger of those by two orders of magnitude.
  • Salary history cannot inform the offer either. The New York City Human Rights Law includes a salary history inquiry ban among its protected categories, alongside credit history, caregiver status, unemployment status and others with no state analogue. Note also that New York’s executive and administrative exempt salary threshold is $1,275.00 per week – $66,300 a year – for New York City, Nassau, Suffolk and Westchester from 1 January 2026, and that New York sets no state salary threshold for the professional exemption, where the federal rule governs. A sales role paid largely in commission still has to clear the salary basis test to be treated as exempt.
