What a New York payroll has to get right

  • Manual workers are paid weekly. Labor Law section 191(1)(a): “A manual worker shall be paid weekly and not later than seven calendar days after the end of the week in which the wages are earned.” Large employers meeting Department of Labor criteria may apply for authorisation to pay semi-monthly; non-profits may negotiate a schedule no less frequent than semi-monthly. There is no de minimis exception, and the classification question – who is a manual worker – has to be answered before the pay calendar is set, not after a demand letter arrives.
  • The May 2025 amendment changed the economics. Labor Law section 198(1-a), revised 16 May 2025 in the FY2026 State Budget, caps damages for a first frequency-of-pay violation at “no more than one hundred percent of the lost interest found to be due for the delayed payment of wages”, calculated at a daily rate based on the annual rate prescribed by the Superintendent of Financial Services under Banking Law section 14-a. That relief is available only where the employer “paid the employee wages on a regular payday, no less frequently than semi-monthly.” For any employer with a previous finding after the amendment’s effective date, full liquidated damages of 100 percent of the wages found due return. Note also that whether section 191 carries a private right of action is unsettled: the First Department found one in 2019 and the Second Department held otherwise in January 2024. Treat the split as open and take advice.
  • Every wage statement has a fixed field list, and non-exempt employees get four more. Labor Law section 195(3) requires dates of work covered, employee name, employer name, address and telephone, rates and basis of pay, gross wages, deductions, allowances claimed, and net wages – plus, for non-exempt employees, the regular hourly rate, the overtime rate, the number of regular hours worked and the number of overtime hours worked. Payroll records are established, maintained and preserved for not less than six years under section 195(4). Statement failures carry $250 for each work day to a $5,000 cap under section 198(1-d); missing hiring notices carry $50 per work day to a further $5,000 under section 198(1-b), and the hiring notice must be in English and the employee’s identified primary language with a signed acknowledgment kept six years.
  • Two rate floors to carry. From 1 January 2026 the minimum wage is $17.00 in New York City, Nassau, Suffolk and Westchester and $16.00 in the remainder of the state; service employees run at $14.15 cash plus a $2.85 tip credit, food service workers at $11.35 plus $5.65 in the higher region. The executive and administrative exempt salary threshold is $1,275.00 per week – $66,300 annually – in the higher region and $1,199.10 elsewhere. From 2027 the minimum wage is indexed to a three-year average of the Northeast Consumer Price Index; no 2027 dollar figure has been published yet, so treat any you see as unverified.

Human resources assistants number 7,640 at a location quotient of 1.39 and $57,050.
  • The wage spread across the metro is the practical problem. Manhattan averages $3,422 a week, Queens $1,410, Brooklyn $1,242 and Nassau and Suffolk both $1,634 – the only identical pair in the region. A single payroll running across those counties is running one minimum wage region but four very different wage bases, and the frequency-of-pay rule bites hardest where hourly and manual work concentrates.
