What a New York City leave configuration actually has to hold
- State sick leave is tiered, carries over, and is capped on use rather than accrual. Labor Law section 196-b gives 40 paid hours at 5 to 99 employees and 56 paid hours at 100 or more, with 40 unpaid hours where an employer has four or fewer employees and net income of $1 million or less in the prior tax year – and 40 paid where that income test is exceeded. Accrual runs at not less than one hour per 30 hours worked from commencement of employment; front-loading is permitted but the employer may not later reduce or revoke based on hours actually worked. Unused sick leave carries over, though use may be capped at 40 or 56 hours a year. Minimum increments may be set but not above four hours. No payout on separation, and the employee must be restored to the same position, pay and terms.
- The city added 32 unpaid hours on 22 February 2026 – and they do not carry over. Local Law 145 of 2025, enacted 25 October 2025 with an effective date of 22 February 2026, gives every New York City employee 32 hours of immediately-available unpaid protected time off, granted on the first day of work and again on the first day of each calendar year. The accrued 40 or 56 paid hours carry over; the 32 do not – they reset. Covered reasons expand to include care for a minor child or care recipient, attending legal proceedings relating to subsistence benefits or housing, responding to a public disaster, and responding to workplace violence. The law also absorbs and largely replaces the Temporary Schedule Change Act. The implementing rule took effect 23 July 2026. Note that several trackers publish 25 October 2025 as the effective date; that is the enactment date.
- Twenty hours of paid prenatal leave sit on top, at every employer size. Labor Law section 196-b(4-a), effective 1 January 2025: “twenty hours of paid prenatal personal leave during any fifty-two week calendar period”, in addition to sick leave, covering physical examinations, medical procedures, monitoring and testing, and discussions with a health care provider related to the pregnancy. It may be taken in hourly increments, is paid at the greater of the regular rate or the applicable minimum wage, and carries no payout on separation. There is no employer size tier – a three-person employer owes the full 20 hours. New York City requires it in addition to protected time off, per a rule effective 2 July 2025.
- And Paid Family Leave costs the employer nothing in premium. For 2026 the employee contribution is 0.432 percent of gross wages per pay period to an annual maximum of $411.91, funding 12 weeks of leave at 67 percent of the employee’s average weekly wage, capped at 67 percent of the state average weekly wage of $1,833.63 – a maximum weekly benefit of $1,228.53. Most private employers with one or more employees must obtain coverage. The rate and cap change each January, which makes it a payroll configuration item rather than a benefits renewal item.
