What New York rules require of an HR technology stack

  • Automated hiring tools need an independent bias audit, published. Local Law 144 of 2021, at Administrative Code sections 20-870 to 20-874, took effect 1 January 2023 with enforcement from 5 July 2023. An automated employment decision tool is a computational process derived from “machine learning, statistical modeling, data analytics, or artificial intelligence” producing a simplified output that substantially assists or replaces discretionary decision-making for hiring or promotion. A bias audit within one year of use is mandatory, by an independent auditor with no employment by, financial interest in, or prior involvement with either the employer or the vendor. The audit must calculate selection or scoring rates and impact ratios across sex, race and ethnicity, and intersectional categories, and a summary must be published on the employer’s website including the audit date, data source, number assessed, applicant counts, selection rates and impact ratios.
  • And candidates must be told ten business days beforehand. Notice must be given at least 10 business days before the tool is used, by job posting, email, mail or website, identifying the job qualifications and characteristics the tool assesses and allowing a request for an alternative selection process or accommodation. Penalties are not more than $500 for a first violation and $500 to $1,500 for each subsequent violation – but “each day on which an automated employment decision tool is used in violation… shall give rise to a separate violation”, and failure to give any notice is a separate violation again. The headline numbers are small; the daily accrual is not.
  • Payroll records run six years, not three. Labor Law section 195(4) requires employers to “establish, maintain and preserve for not less than six years contemporaneous, true, and accurate payroll records.” Section 195(3) fixes what every wage statement must carry: dates of work covered, employee name, employer name, address and phone, rates and basis of pay, gross wages, deductions, allowances claimed, and net wages – plus, for non-exempt employees, the regular hourly rate, the overtime rate, the number of regular hours worked and the number of overtime hours worked. Missing any of that runs at $250 per work day to a $5,000 cap under section 198(1-d).
  • Manual workers are a payroll-engine problem, not a policy problem. Labor Law section 191(1)(a) requires that “a manual worker shall be paid weekly and not later than seven calendar days after the end of the week in which the wages are earned.” Large employers meeting Department of Labor criteria may apply for authorisation to pay semi-monthly. A system configured for a uniform bi-weekly cycle cannot comply for that population without an authorisation on file, and the classification question – who counts as a manual worker – has to be answered somewhere in your data model.
