Where the state rule and the city rule diverge
- The state floor: Labor Code section 246, no size threshold. Accrual is not less than one hour per 30 hours worked, beginning at employment, usable from the 90th day. An employer may cap use at 40 hours or 5 days per year, and need not allow total accrual to exceed 80 hours or 10 days. Accrued days carry over. A front-load alternative is available if the full amount – defined as five days or 40 hours – is granted at the start of each year. No payout on separation, but unused leave is reinstated if the employee is rehired within a year. The available balance must appear on the wage statement or in a separate writing on payday.
- The city rule: San Diego Municipal Code ch. 3, art. 9, div. 1, in force since 11 July 2016. Same one-in-thirty accrual and same 40-hour annual use cap the employer may impose – but an 80-hour accrual and balance cap and, critically, carryover of unused accrued leave is mandatory. A front-load alternative of at least 40 hours at the start of the benefit year is available with use capped at 40. Uses include the employee’s own and family medical care and safe time for domestic violence, sexual assault and stalking.
- How they interact. Both apply, and the employer must satisfy whichever provision is more generous provision by provision – not choose one policy wholesale. The accrual rate and the 40-hour annual use entitlement are identical. The binding city-specific terms are the 80-hour cap and compulsory carryover. A policy configured only to the state rule will be non-compliant on carryover inside city boundaries.
- And pregnancy leave stacks rather than overlaps. CFRA at Government Code section 12945.2(b)(5)(C) expressly excepts leave taken for disability on account of pregnancy, childbirth or related conditions – that is Pregnancy Disability Leave under Government Code section 12945(a)(1), up to four months at an employer with five or more employees, with group health coverage maintained for up to four months over a 12-month period. Because PDL sits outside CFRA, PDL and CFRA baby-bonding can run consecutively, producing an entitlement materially longer than FMLA’s 12 weeks. Bereavement leave (section 12945.7) and reproductive loss leave (section 12945.6) each add up to five days at the same five-employee threshold.
- Plus the federal layer. COBRA at 20 employees in the prior calendar year at up to 102% of plan cost; ACA applicable large employer status at 50 full-time employees including full-time equivalents on a prior-year look-back, with related companies generally combined under section 414 of the Internal Revenue Code (IRS, page reviewed 8 August 2026); and Form 5500 at 100 plan participants measured at the start of the plan year.
