What governs hiring in San Diego, by geography
- Statewide: the California Fair Chance Act, at five employees. Government Code section 12952 prohibits any conviction-history question on an application before a conditional offer, and any inquiry into or consideration of conviction history until after one. Arrests not followed by conviction, diversion participation, and sealed, dismissed, expunged or pardoned convictions may never be considered. Where the employer intends to deny based on conviction history it must conduct an individualised assessment weighing the nature and gravity of the offence, the time elapsed, and the nature of the job; give preliminary written notice identifying the disqualifying conviction with a copy of the report; allow at least five business days to respond, plus five additional business days where the applicant disputes accuracy and is gathering evidence; consider the response; and give a final written notice stating any procedure to request reconsideration and the right to file with the Civil Rights Department. The Civil Rights Council’s implementing regulations at 2 C.C.R. section 11017.1 took effect 1 October 2023.
- Unincorporated San Diego County: more than that. San Diego County Code section 114175, adopted 10 September 2024 and effective 10 October 2024, adds a mandatory individualised written assessment, procedural notice before an offer is withdrawn, and county enforcement rather than routing to the state. Penalties took effect 1 July 2025: up to $5,000 for a first violation, $10,000 second, and $20,000 third and subsequent, with at least half of collected penalties going to the aggrieved applicant. It covers roughly 413,130 workers and 15,000 employers. It does not apply in the City of San Diego, Chula Vista, Carlsbad, Escondido or Oceanside.
- The City of San Diego has no separate fair chance ordinance – state Government Code section 12952 governs inside city limits. That is a search that returned nothing rather than an affirmative confirmation, so treat it as “none identified.”
- Pay disclosure and salary history. Labor Code section 432.3(a) and (b) bar an employer from relying on or seeking salary history, orally or in writing, personally or through an agent – though salary expectations may be asked under section 432.3(j), and prior salary can never justify a disparity under section 432.3(k). The pay scale must be given to an applicant on reasonable request at all employers under section 432.3(c)(1), and included in any job posting at 15 or more employees under section 432.3(c)(3). As amended by SB 642, effective 1 January 2026, “pay scale” now means a good faith estimate of the range the employer reasonably expects to pay upon hire. Penalties run from $100 to $10,000 per violation, with no penalty for a first subdivision (c) violation if all postings are updated. Job title and wage rate history must be retained for the duration of employment plus three years.
- And automated screening is now evidence. The Civil Rights Council’s employment regulations on automated-decision systems took effect 1 October 2025, covering resume screening, video-interview analysis and applicant targeting, making anti-bias testing relevant to claims and defences, and extending record retention for selection criteria to four years.

- And candidate availability improved. Unemployment in the San Diego MSA was 4.4% in June 2026 against 4.7% a year earlier, on a labour force of 1,640,465 with 72,909 unemployed – a genuine improvement, and unusual in this project. Payroll employment reached 1,573,500 seasonally adjusted in July 2026, up 11,600 or 0.74% over the year. The two series run a month apart and should not be blended; there is also no October 2025 figure, because the data was not collected during the 2025 lapse in appropriations.
- Where hiring is happening, and where it is not. Private education and health services grew 5.1% over the year to July 2026 to 284,300, other services 4.3% and leisure and hospitality 2.0%, while information fell 6.5% to 17,200, construction 3.2%, government 2.5% and financial activities 2.4%. In the county, health care and social assistance employed 237,744, up 4.8% (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026).
