- Uncapped compensatory, capped punitive. Fla. Stat. section 760.11 allows back pay, compensatory damages including mental anguish and loss of dignity with no statutory cap, punitive damages capped at $100,000, and attorney fees at the court’s discretion, with the right to a jury trial preserved. Sections 768.72 and 768.73 do not apply. Federal Title VII, by contrast, caps combined compensatory and punitive damages at between $50,000 and $300,000 depending on employer size. In Florida the uncapped element is the one that moves, and what drives it is conduct – what a senior person said, in front of whom, and what the organisation did next.
- The claim has to survive a procedural gauntlet first, and the gates are short. A charge must be filed within 365 days with the Florida Commission on Human Relations. The FCHR must determine reasonable cause within 180 days. On a cause finding the complainant makes an exclusive election between a civil action and a chapter 120 administrative hearing, and must request the hearing within 35 days; on a no-cause dismissal, an administrative hearing must be requested within 35 days or the claim is barred. Since ch. 2026-116 (approved 22 May 2026, effective 1 July 2026), a civil action must be brought within one year of the earlier of an FCHR cause determination or an EEOC right-to-sue notice, or within 18 months of the complaint if neither issues inside 180 days.
- Locally the threshold is lower and the characteristics are broader. Palm Beach County Code ch. 2, Article VI reaches 15 employees after only four weeks, allows 180 days to file, protects familial status, marital status, sexual orientation, gender identity and genetic information, and imposes an express reasonable accommodation duty. - Retaliation is the separate claim, at ten employees. The Florida Private Whistleblower Act, Fla. Stat. sections 448.101 to 448.105, applies to any private employer with ten or more persons. In practice the retaliation claim frequently outlives the underlying complaint, and it is almost always about how a senior person reacted rather than about the original conduct.
