What governs a Boca Raton hiring process
- Florida restricts neither salary history nor pay disclosure – but your posting may not be Florida-only. There is no Florida salary history ban and no Florida pay transparency statute; no such provision exists anywhere in Fla. Stat. ch. 448 or ch. 760, and Fla. Stat. section 218.077 prevents Palm Beach County or the City of Boca Raton creating one. Nationally the picture is different: more than 20 states and localities restrict salary history inquiries, Virginia’s taking effect 1 July 2026, and 17 states plus the District of Columbia have enacted pay transparency laws, with 16 plus DC in force. A role posted from Boca Raton and open to candidates in Colorado, California or New York can pick up that state’s posting duty. This is the most common recruiting compliance error we see in Florida-headquartered employers.
- Palm Beach County protects genetic information, which changes what you may screen for. Palm Beach County Code ch. 2, Article VI covers genetic information alongside familial status, marital status, sexual orientation and gender identity, and imposes an express reasonable accommodation duty. Genetic information is not enumerated in the Florida Civil Rights Act, and neither is sexual orientation or gender identity. Federal GINA covers genetic information at 15 employees; the county chapter reaches the same headcount but after only four weeks rather than the 20 weeks the FCRA and Title VII require.
- The City of Boca Raton adds nothing. The full city code contains no human rights chapter and no employment ordinance, so the county chapter and state law are the whole local picture – unlike Fort Lauderdale, where both a county and a city code apply.
- E-Verify is a post-hire step, not a screen. Fla. Stat. section 448.095 requires employers with 25 or more employees to run E-Verify within three business days of the first day the employee works for pay. Running it on a candidate, or conditioning an interview on it, is outside what the statute contemplates. Bona fide independent contractors are excluded entirely.
- Equal pay exposure begins at the offer, at two employees. Fla. Stat. section 448.07 applies from two employees, and a pay differential defensible only by what the candidate previously earned is not among its recognised defences, which are seniority, merit, quantity or quality of production, or another reasonable factor other than sex applied in good faith.
