What a PEO shifts in Florida, and what stays with you

  • The subcontractor verification duty is yours. Fla. Stat. section 440.10(1)(g) requires a contractor to verify that every subcontractor has secured workers compensation coverage before the subcontractor begins work. It is a duty of the contracting entity, not of a leasing company, and it does not transfer. In a county with 43,073 construction jobs it is the single most consequential provision on this page.
  • Construction coverage starts at one employee. Fla. Stat. section 440.02(20)(b)2 requires coverage for all private employment with four or more employees, and for all construction employment with one or more. Full-time and part-time employees both count, and the Florida Division of Workers Compensation states coverage applies whether the employee works at the employer’s location or remotely. Agriculture is six or more regular employees and twelve or more seasonal working 30 or more days.
  • Officer exemptions are capped and personal. Under Fla. Stat. section 440.05 a construction corporation or affiliated group may exempt a maximum of three officers, each holding at least 10% ownership, at $50 each, and a construction LLC is likewise capped at three members. Non-construction employers face no cap on corporate officers and no fee, and may exempt up to ten LLC members. Since 1 January 2023 every applicant must view the Division’s online tutorial and attest to it. An exempt officer cannot recover benefits, and the certificate attaches to the individual rather than the seat.
  • A leasing company is an employer by statute – for coverage. Fla. Stat. section 440.02(19)(a) treats employee leasing companies and employment agencies supplying their own employees as employers. That is the genuine transfer a PEO offers. But Fla. Stat. section 448.095(2)(f) provides that a leasing company need not run E-Verify where a written agreement places the primary obligation on the client company – so whether your E-Verify duty has moved is a contract question, not a statutory one.
  • Out-of-state coverage does not travel. An out-of-state employer needs a Florida policy or a Florida 3.A. endorsement, with extraterritorial reciprocity limited to 10 consecutive days or 25 total days in a calendar year.
