What a 2026 California onboarding pack has to produce

  • The Workplace Know Your Rights notice. SB 294 added Labor Code sections 1550 to 1558. Section 1553(a) requires a stand-alone written notice – not folded into a handbook – to each current employee on or before 1 February 2026 and annually thereafter, and to each new employee upon hire, delivered in a manner the employer normally uses for employment information. Content: workers’ compensation rights and Division of Workers’ Compensation contact details; the right to notice of an immigration-agency inspection under Labor Code section 90.2(a); protection against unfair immigration-related practices; the right to organise a union or engage in concerted activity; and constitutional rights when interacting with law enforcement at the workplace. It must be in the language the employer normally uses where the employee understands it and a template exists. Compliance records must be kept three years, including the date each notice was provided.
  • And an emergency contact designation with a hard date. Section 1555 requires employers to give employees the opportunity to designate an emergency contact no later than 30 March 2026 for existing employees, and at hire thereafter, and to notify that contact if the employee is arrested or detained on the worksite. Penalties under section 1558(d) run to $500 per employee per violation, and for a section 1555 failure up to $500 per employee per day capped at $10,000 per employee.
  • Training records became inspectable personnel records. SB 513 amended Labor Code section 1198.5(a) effective 1 January 2026 so that personnel records subject to inspection expressly include education or training records. Where maintained, each must include the employee’s name, the training provider’s name, the duration and date, the core competencies covered including equipment or software skills, and any resulting certification or qualification. The 30-calendar-day production deadline is unchanged. Given that Government Code section 12950.1 mandates two hours of supervisory harassment training every two years at five employees, this converts a loosely kept file into a structured one.
  • Plus the standing items. The pay scale must be given to an applicant on reasonable request and to a current employee for their own position at all employers under Labor Code section 432.3(c)(1) and (c)(2). The written workplace violence prevention plan under Labor Code section 6401.9, operative since 1 July 2024, must be “available and easily accessible” at all times and specific to the hazards of each work area. And the paid sick leave balance must appear on the wage statement or in a separate writing on payday under Labor Code section 246(i).
  • No City of Irvine or Orange County onboarding requirement was identified. That is a real simplification: a San Francisco or San Diego packet has to carry local sick leave terms and, in San Francisco’s case, a Fair Chance poster updated on 10 August 2026.
