Texas defines an employer, for sexual harassment claims, as anyone who employs one or more employees — not the fifteen-employee Title VII threshold — and an unlawful practice occurs where the employer or its agents knew or should have known and failed to take immediate and appropriate corrective action. (Texas Labor Code §§ 21.141–21.142, added by SB 45, effective 1 September 2021.) That is a stricter formulation than federal law, and it makes the quality and speed of your investigation the central factual question.

The filing window is 300 days for sexual harassment, against 180 days for other discrimination claims under Chapter 21. (§ 21.202.) An investigation conducted today may be examined nearly a year later, by people reading only what was written down at the time.

General discrimination coverage begins at fifteen employees. (§ 21.002(8).) So a twelve-person Dallas company sits outside Chapter 21 for most claims and squarely inside it for sexual harassment — a distinction that surprises most owners.
