HR compliance in Texas: what Dallas employers must get right

Texas adds little above the federal floor — no state paid sick leave, no pay transparency requirement, no salary history ban, no meal or rest break mandate, no state mini-WARN act, and no mandatory harassment training for private employers. That absence is why most Texas employers assume compliance is simple. Four things are not.

Sexual harassment liability starts at one employee. For sexual harassment claims Texas defines an employer as anyone who employs one or more employees — not the fifteen-employee threshold under Title VII — and the standard is failure to take immediate and appropriate corrective action. The filing window is 300 days, against 180 for other discrimination claims. (Texas Labor Code §§ 21.141–21.142, effective 1 September 2021.)

Final pay is six days. A discharged employee must be paid in full no later than the sixth day after discharge; an employee who resigns is paid on the next regularly scheduled payday. A final check cannot be held because equipment has not been returned. (Texas Labor Code § 61.014.)

Payroll deductions need written authorization. No withholding without a court order, a statutory basis, or the employee’s written authorization for a lawful purpose. (Texas Labor Code § 61.018.)

Your PTO policy can create wages you did not intend. Vacation, sick, parental and severance pay owed under a written policy count as wages and become enforceable as such. (Texas Labor Code § 61.001(7).)

And Dallas has no paid sick leave requirement: the city ordinance was permanently enjoined on 31 March 2021 as preempted by the Texas Minimum Wage Act. (ESI/Employee Solutions, L.P. v. City of Dallas, No. 4:19-cv-00570-SDJ, E.D. Tex.)

Dallas’s labor market and what it means for hiring

Dallas-Fort Worth is HR-dense and, unusually for a market this expensive, HR-inexpensive.

The metro employs 7,970 human resources managers at an annual mean wage of $156,380 — 4.8% below the national mean of $164,230 — with a location quotient of 1.39, meaning HR managers are 39% more concentrated here than nationally. HR specialists show the same pattern: 29,190 of them at $75,220 against $81,990 nationally, at a location quotient of 1.23. (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026.)

That inversion is the whole argument. Across all occupations Dallas-Fort Worth pays $70,630 against $69,770 nationally — slightly above. For HR specifically it pays below. The metro has an unusually deep bench of HR people and does not pay a premium for them, which means a full-time senior HR hire is available but rarely justified at the headcount where most employers first want one.

The growth backdrop is the reason the question comes up at all. Dallas-Fort Worth added 54,600 jobs over the year to June 2026, the largest over-the-year increase of any US metro, ahead of Las Vegas and Phoenix, and accounted for roughly 28% of all job growth in Texas. (BLS, released 29 July 2026.) Metro unemployment was 4.7% in June 2026, up from 4.0% a year earlier and above the national 4.4%. (BLS Local Area Unemployment Statistics, preliminary.)

Sector by sector the growth is lopsided. Professional and business services grew 3.01% and leisure and hospitality 3.05% over the year to July 2026, while manufacturing fell 0.70%, financial activities 1.04% and information 2.82%. (BLS Current Employment Statistics, July 2026, preliminary, not seasonally adjusted.) Government employment in Dallas grew 0.24% while national government employment fell 1.13% — a divergence of 1.37 points.

For an employer the practical consequence is that compliance risk here sits in classification, final pay, documented investigations and the workers’ compensation decision — not in state-specific filings, because there are hardly any.

How we support Dallas employers

We work remotely from Melissa, Texas — inside the same metro area, under the same state employment law, with no travel premium. Video-first working sessions, multi-state payroll and compliance tooling, and response times agreed at the start. We do not have a Dallas office and do not claim one. What we have is Texas employment law as our home jurisdiction.

Frequently asked questions about fractional HR in Dallas

What does fractional HR cost in Dallas compared with hiring an HR manager?

Dallas-Fort Worth employs 7,970 human resources managers at an annual mean wage of $156,380, before benefits, payroll taxes or recruiting costs. (BLS Occupational Employment and Wage Statistics, May 2025 estimates.) A fractional engagement provides that seniority for the hours you actually need.

Does Dallas require employers to provide paid sick leave?

No. The city ordinance adopted in 2019 was preliminarily enjoined in March 2020 and permanently enjoined on 31 March 2021 as preempted by the Texas Minimum Wage Act. Texas has no statewide requirement either.

How quickly must a Texas employer issue a final paycheck?

Six days after discharge; on the next regularly scheduled payday if the employee resigns. (Texas Labor Code § 61.014.)

Does Texas require sexual harassment training for private employers?

No — the training requirement in Texas Labor Code § 21.010 covers state agencies only. But liability begins at one employee, and the standard is failure to take immediate and appropriate corrective action. (Texas Labor Code §§ 21.141–21.142.)

Is workers’ compensation required in Texas?

No. Texas is the only state where private employers may opt out, subject to posting, written notice to employees and an annual filing with the Division of Workers’ Compensation between 1 February and 30 April.

Why does Dallas pay less for HR than the national average?

Concentration. Location quotients are 1.39 for HR managers and 1.23 for HR specialists, meaning both are substantially more common in Dallas-Fort Worth than nationally, while the metro pays 4.8% and 8.3% below national means respectively. (BLS OEWS, May 2025.)

Which Dallas sectors are growing fastest?

Leisure and hospitality at 3.05% and professional and business services at 3.01% over the year to July 2026. Manufacturing, financial activities, wholesale trade and information all contracted. (BLS Current Employment Statistics, July 2026, preliminary.)
