None of those first three characteristics is enumerated in the Florida Civil Rights Act, and the four-week test attaches roughly four months earlier than the FCRA’s 20 weeks. Pre-employment health questionnaires and family medical history questions are where this reaches an actual hiring process.
  • E-Verify is post-hire, not a screen. Fla. Stat. section 448.095 requires employers with 25 or more employees to run E-Verify within three business days of the first day the employee works for pay. Running it on a candidate, or conditioning an interview on it, is outside what the statute contemplates. Bona fide independent contractors are excluded entirely.
  • Equal pay exposure starts at the offer, at two employees. Fla. Stat. section 448.07 applies from two employees, and a differential defensible only by what a candidate previously earned is not among its recognised defences. Where the hire is senior, check any incoming candidate’s restrictive covenants: the Florida CHOICE Act, ch. 2025-213 effective 1 July 2025, permits covered noncompete and garden leave terms of up to four years enforced by a preliminary injunction the court must grant on application.
