The two payroll regimes a West Palm Beach employer may be under
- Regime one: City construction contracts over $200,000. City of West Palm Beach Code ch. 66, Article X, adopted as Ordinance 4744-17, applies a living wage to employees on City construction contracts exceeding $200,000 – not City service contracts, and not private employers generally. Published rates were $14.00 an hour from 1 April 2018 and $15.00 from 1 October 2019; we do not publish a current rate, not having confirmed the 2026 figure from a primary source, and a contractor should take it from the City rather than from any secondary listing. Complaints run to a special master within one year; a violation can carry debarment for up to three years; and retaliation is prohibited with a rebuttable presumption attaching to any adverse action within 90 days of a complaint. Palm Beach County separately imposes a living wage under Code ch. 2, Article IV, Division 3 on paratransit and county construction contracts over $100,000 not subject to Davis-Bacon, on a 2013 base of $11.64 adjusted for CPI each 1 October.
- Both end for new contracts on 30 September 2026. Section 3 of ch. 2024-80 preserves local living wage terms only in contracts entered into before that date; from then Fla. Stat. section 218.077(2)(b) and (c) bar a Florida city or county from using purchasing or contracting procedures to control contractor wages at all. Existing contracts run out on their own terms, so many payrolls will carry two rules at once through 2027.
- Regime two, which everyone is under: the state act. Florida’s minimum wage rises from $14.00 to $15.00 on 30 September 2026 under Fla. Const. Art. X, section 24(c), self-executing, with the tipped direct cash wage moving from $10.98 to $11.98 against a tip credit frozen at $3.02. There is no headcount threshold: Fla. Stat. section 448.110(3) covers everyone entitled to the federal minimum wage, incorporating the FLSA exemptions at sections 13 and 214. Since ch. 2023-222 an employee must serve written notice and allow 15 calendar days to cure before suing (section 448.110(6)), with remedies of unpaid wages plus equal liquidated damages, fees and costs, $1,000 per willful violation payable to the state, and a four-year limitation period, five if willful.
- And there is no county wage claim route. Palm Beach County has no wage theft ordinance – only the Legal Aid Society Wage Dispute Project funded under Resolution R-2012-1857, a legal services contract. Fla. Stat. section 448.109 still requires the minimum wage poster in English, Spanish and Creole at each establishment.
