Which duties transfer to a PEO in Florida, and which stay
- Transfers by statute: workers compensation. Fla. Stat. section 440.02(19)(a) treats employee leasing companies and employment agencies that supply their own employees as employers. That is the genuine transfer, and it is the core of the PEO proposition. The underlying thresholds are worth knowing: coverage is required for all private employment with four or more employees and for all construction employment with one or more, counting full-time and part-time alike including remote workers (Fla. Stat. section 440.02(20)(b)2).
- Transfers only by contract: E-Verify. Fla. Stat. section 448.095(2)(f) provides that a leasing company need not verify where a written agreement places the primary obligation on the client company. So the duty follows your service agreement, not the arrangement. Read it. The underlying rule is 25 or more employees, verified within three business days of the first day worked for pay, with three-year retention.
- Does not transfer at all: your own contract obligations. If you hold a City of West Palm Beach construction contract over $200,000, City Code ch. 66, Article X (Ordinance 4744-17) binds you as the contracting party.
