What co-employment actually changes in Florida
Two Florida-specific features make the PEO decision here different from other states, and both are commonly misunderstood at signing.
E-Verify and the employee leasing carve-out. Florida requires private employers with 25 or more employees to verify each new hire within three business days, retain documentation three years, and certify compliance annually. Three failures in any 24-month period bring $1,000 per day until cured, plus grounds for suspension of every state licence you hold. There is a leasing provision: where a written agreement places the primary obligation on the client company, the leasing company need not verify. (Fla. Stat. § 448.095(2)(f).) That cuts both ways — the obligation does not vanish, it lands wherever the contract puts it, and employers frequently assume the PEO has it when the agreement says the opposite. Read the clause.
