Independent contractors are excluded. (Fla. Stat. § 448.095.) A 2026 bill to extend this to all employers regardless of size passed the House in January but died in the Senate on 13 March 2026.
Equal pay from two employees. Florida prohibits sex-based pay differences for equal work at any employer with two or more staff, which puts starting-salary decisions inside a statute far earlier than the Florida Civil Rights Act’s fifteen-employee threshold. (§ 448.07.)
The Florida Civil Rights Act itself covers race, color, religion, sex, pregnancy, national origin, age, handicap and marital status at fifteen employees, with a 365-day filing deadline — longer than the EEOC’s 300 days. Age is protected with no minimum age floor, unlike the federal ADEA. (§§ 760.02, 760.10, 760.11.)
And factor the wage floor into offers: the state minimum rises to $15.00 an hour on 30 September 2026, from $14.00. (Fla. Const. Art. X § 24.)
