Benefits obligations in Florida: almost none, with two exceptions

Florida mandates remarkably little. No state paid sick leave, no state family leave beyond federal FMLA, no requirement to offer health coverage, and no PTO or vacation payout mandate — accrued time is not wages by statute, and payout is governed entirely by your own policy or contract. Local governments are preempted from adding any of these; the preemption statute expressly names sick leave, vacation and personal necessity days. (Fla. Stat. § 218.077(1)(d).)

Two leave obligations do exist and are easy to miss.

Florida domestic violence leave applies at 50 or more employees, for employees with three months’ service: up to three working days per twelve-month period, paid or unpaid at your discretion, for injunctions, medical or mental health care, victim services, securing housing or legal matters. The employee must exhaust annual, vacation, personal and sick leave first unless you waive it, and you must keep the information confidential. (Fla. Stat. § 741.313.)

Miami-Dade County adds its own domestic leave ordinance, binding private employers with 50 or more employees working in the county, and it is more generous than the state provision. (Miami-Dade County Code ch. 11A, art. VIII.) Notably, domestic violence and sexual abuse ordinances are expressly carved out of Florida’s preemption statute, which is why the county version survives. One dated change: the Miami-Dade living wage requirement, which includes a health benefit component, ends for county contracts awarded on or after 30 September 2026 under state preemption. That holds until an ACA filing deadline, a carrier audit and a mid-year plan change arrive in the same fortnight.

Cost pressure is concentrated. Education and health services grew 2.5% over the year — the only strong grower among eleven supersectors, seven of which are contracting. Healthcare demand rising while the rest of the metro is flat feeds directly into plan costs and into competition for the staff who administer them.
