Outsourced HR Services for Small Businesses in New York NY

Small New York City employers are not exempt from much. The state discrimination law and annual harassment training start at one employee, paid family leave at one, and the city’s fair chance, salary posting and human rights rules at four. Only the scheduling law waits, and it waits for sector rather than size.

How Outsourced HR Services Work

Exceptional HR Solutions begins with a comprehensive review of the business’s current HR environment. This includes assessing policies, compliance practices, workforce structure, and leadership priorities.

Where the thresholds actually fall

  • One employee: discrimination, training, family leave, prenatal leave. Executive Law section 292(5) defines employer as “all employers within the state”, under a standard that disclaims “severe or pervasive” and leaves a defense only for conduct amounting to no more than petty slights or trivial inconveniences, with three years to file and punitive damages available. Labor Law section 201-g requires an annual interactive training and written policy for every employer, in each employee’s identified primary language, at hire and at every training. Paid Family Leave coverage attaches at one employee, funded entirely by an employee contribution of 0.432 percent of gross wages in 2026 capped at $411.91. And 20 hours of paid prenatal personal leave apply with no size tier at all.
  • Four or fewer: a sick leave tier that turns on your tax return. Labor Law section 196-b gives an employer of four or fewer employees 40 unpaid hours where net income was $1 million or less in the prior tax year, and 40 paid hours where it exceeded that. In New York City, domestic workers at an employer of four or fewer get 40 paid hours regardless of the income test. Above four, the tiers are 40 paid from five to 99 and 56 at 100 or more. Every city employee, at any employer size, also has the 32 hours of immediately-available unpaid protected time off introduced on 22 February 2026.
  • Four employees: the city’s main rules switch on. The New York City Fair Chance Act – covering interns, freelancers and independent contractors – the salary transparency rule at Local Law 32 of 2022, and the city human rights law all apply at four or more employees, with the human rights law reaching any size for gender-based harassment. State pay transparency at Labor Law section 194-b also begins at four. Fifteen brings Local Law 96 training, records, poster and factsheet – and independent contractors count toward the 15, which is how a lean firm with freelancers gets there earlier than expected.
  • And the scheduling law is about sector, not size. The Fair Workweek Law reaches fast food chains with 30 or more locations nationally and retail employers with 20 or more employees aggregated across all New York City locations under common ownership or management. A twelve-person independent shop is outside it; a twelve-person franchise of a national chain may not be. Separately, Cal-style small-employer relief does not exist for records: payroll is preserved not less than six years under Labor Law section 195(4) whether you employ four people or four thousand.

We are not attorneys and this is not legal advice. Threshold counting has real consequences and belongs with New York employment counsel where it is close.

What small looks like in New York City

  • Establishment sizes vary widely by borough. Manhattan runs 130,297 establishments for 2,520,287 covered jobs – about 19 per establishment – against Brooklyn’s 75,628 for 928,387, roughly 12, and Queens’ 57,963 for 755,489, roughly 13, all calculated from the published figures (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026). Outside Manhattan this is a city of small employers.
  • And of very different wage bases. Average weekly wages ran $3,422 in Manhattan, $1,417 in the Bronx, $1,410 in Queens, $1,350 in Staten Island and $1,242 in Brooklyn, against a United States average of $1,569. Citywide, private sector employment reached 4,219,200 in July 2026, up 64,000, with unemployment at 5.0 percent seasonally adjusted (New York State Department of Labor).
  • The in-house alternative is out of reach at this size. New York City employs 11,720 human resources managers at an annual mean of $213,376 and 30,000 human resources specialists at $103,613, against all occupations at $95,518 (New York State Department of Labor occupational wages, May 2025 base updated to Q1 2026; NYSDOL states these estimates are not produced nor reviewed by the Bureau of Labor Statistics).

How we work with smaller New York City employers

Exceptional HR Solutions has one physical location, in Melissa, Texas, and no New York office. For an employer under about 50 people the honest answer is usually that you need a defined set of documents that are right, a calendar that fires before each deadline, and someone to call when something unusual happens – not a retained HR department. We build the first two and keep the third proportionate. We are not counsel, and where a question needs a lawyer we would rather say so early than bill for the detour.

Questions

Frequently asked questions

Does New York discrimination law apply to small employers?

Yes. Executive Law section 292(5) defines employer as all employers within the state, with no numeric minimum. The city law generally starts at four persons but reaches any size for gender-based harassment.

Do we need harassment training with two employees?

Yes. Labor Law section 201-g requires an annual interactive training and a written policy for every employer regardless of size, in each employee’s primary language.

How much sick leave does a very small employer owe?

Forty unpaid hours if you have four or fewer employees and net income of $1 million or less in the prior tax year; 40 paid hours if it exceeded that. Domestic workers in New York City get 40 paid hours regardless.

At what size do the New York City hiring rules apply?

Four or more employees for the Fair Chance Act and for salary transparency under Local Law 32. Local Law 96 training applies at 15, with independent contractors counting toward the threshold.

Are we covered by the Fair Workweek Law?

Only if you are a fast food chain with 30 or more locations nationally, or a retail employer with 20 or more employees across your New York City locations.

How long must a small employer keep records?

Not less than six years for payroll records under Labor Law section 195(4), with the signed hiring notice acknowledgment preserved for the same period. There is no small-employer relief.

Do you have a New York office?

No. We work remotely from our single location in Melissa, Texas, which is part of why an engagement at this size stays affordable.
