What a California onboarding pack has to produce in 2026
- Training records became inspectable personnel records. SB 513 amended Labor Code section 1198.5(a) effective 1 January 2026 so that personnel records subject to inspection expressly include education or training records. Where an employer maintains them, each must include the employee’s name, the training provider’s name, the duration and date of the training, the core competencies covered – including equipment or software skills – and any resulting certification or qualification. The 30-calendar-day production deadline is unchanged. In a state that mandates two hours of supervisory harassment training every two years under Government Code section 12950.1, that is a record most employers were keeping loosely and now must keep precisely.
- A new stand-alone annual notice. SB 294, the Workplace Know Your Rights Act, added Labor Code sections 1550 to 1558. Section 1553(a) requires a stand-alone written notice – not folded into a handbook – to each current employee on or before 1 February 2026 and annually thereafter, and to each new employee upon hire: workers’ compensation rights and Division of Workers’ Compensation contact details, the right to notice of an immigration-agency inspection under Labor Code section 90.2(a), protection against unfair immigration-related practices, the right to organise, and constitutional rights when interacting with law enforcement at the workplace. Compliance records must be kept three years including the date each notice was sent. Section 1555 requires the opportunity to designate an emergency contact no later than 30 March 2026, and at hire thereafter. Penalties under section 1558(d) run to $500 per employee per violation, and for a section 1555 failure up to $500 per employee per day capped at $10,000 per employee.

- And two documents that must exist on day one.
