What governs an executive hire in San Jose

  • The California Fair Chance Act, at five employees. Government Code section 12952 bars any conviction-history question on an application before a conditional offer, and any inquiry into or consideration of conviction history until after one. Arrests not followed by conviction, diversion participation, and sealed, dismissed, expunged or pardoned convictions may never be considered. Where the employer intends to deny based on conviction history it must conduct an individualised assessment weighing the nature and gravity of the offence, the time elapsed and the nature of the job; give preliminary written notice with a copy of the report; allow at least five business days to respond, plus five more where the applicant disputes accuracy; consider the response; and give a final written notice stating any reconsideration procedure and the right to file with the Civil Rights Department. Implementing regulations at 2 C.C.R. section 11017.1 took effect 1 October 2023.   • Salary history cannot be sought or relied on. Section 432.3(a) and (b) bar relying on or seeking salary history, orally or in writing, personally or through an agent. Salary expectations may be asked under section 432.3(j), and prior salary can never justify a disparity under section 432.3(k).
  • And automated screening became evidence on 1 October 2025. California’s Civil Rights Council automated-decision system regulations cover resume screening, video-interview analysis, skill assessments and applicant targeting; make anti-bias testing relevant to claims and defences; extend retention of selection criteria records to four years; and redefine agent liability at 2 C.C.R. section 11008(b) to reach a person acting on the employer’s behalf, including via an automated decision system – which reaches a search firm using screening tools on your behalf.
