What a five-person California company already owes
- CFRA, and it is broader than FMLA in ways that matter. Government Code section 12945.2(b)(4)(A) applies at five or more persons, against FMLA’s 50 within 75 miles. Employees with more than 12 months and at least 1,250 hours of service get up to 12 workweeks in any 12-month period. The family definition at section 12945.2(b)(5)(B) covers child, parent, grandparent, grandchild, sibling, spouse, domestic partner and a designated person – defined at section 12945.2(b)(2) as any individual related by blood or whose association with the employee is the equivalent of a family relationship, limited to one per 12-month period. FMLA covers none of those last four.
- And pregnancy leave stacks on top rather than running concurrently. CFRA at section 12945.2(b)(5)(C) expressly excepts leave taken for disability on account of pregnancy, childbirth or related conditions. That is Pregnancy Disability Leave under Government Code section 12945(a)(1) – up to four months at a five-employee employer, with group health coverage maintained for up to four months over a 12-month period.
