The duties New York places on people who manage people

  • The policy names supervisors, and it is mandatory at every size. Labor Law section 201-g requires every employer, with no minimum headcount, to adopt the state model policy or one that “equals or exceeds the minimum standards”. Its required contents include examples of prohibited conduct, federal and state remedies, a standard complaint form, a timely and confidential investigation procedure, an anti-retaliation statement, and expressly a statement that harassment is employee misconduct with sanctions against supervisors who knowingly allow it to continue. Training is interactive and annual, and the policy and material go out in English and each employee’s identified primary language at hire and at every training. The model was last updated August 2024.
  • In New York City the training content is explicitly supervisory. Local Law 96 of 2018, effective 1 April 2019, requires annual interactive training at 15 or more employeesindependent contractors count toward the 15 – covering all employees including supervisory and managerial staff and interns, and expressly including bystander intervention and the “specific responsibilities of supervisory and managerial employees in the prevention of sexual harassment.” Records including a signed acknowledgment are kept at least three years. New hires are trained after 90 days where they will work more than 80 hours in a calendar year.
  • Retaliation over an accommodation request became separately actionable in December 2025. The Reasonable Accommodation Anti-Retaliation Act, Chapter 600 of 2025, amended Executive Law section 296 effective 5 December 2025, and applies to all employers. That sits alongside a discrimination standard that is already lower than the federal one – section 296 disclaims “severe or pervasive” and leaves a defence only where conduct amounts to no more than petty slights or trivial inconveniences – with three years to file under section 297(5), and remedies including punitive damages and civil fines up to $50,000, or $100,000 where the conduct is willful, wanton or malicious.
  • And the city law protects more characteristics, at a lower size floor. New York City’s human rights law adds protected categories with no state analogue – caregiver status, credit history, salary history inquiry, pre-employment marijuana testing, unemployment status, sexual and reproductive health decisions, and height and weight – and reaches employers of any size for gender-based harassment under Administrative Code section 8-102. Its filing windows differ from the state’s: one year at the Commission, three for gender-based harassment, three years in court, and no filing in both.
