Where a Manhattan executive’s discretion is constrained
- Delegating a decision to a tool does not delegate the responsibility. New York City’s Local Law 144 of 2021, effective 1 January 2023 with enforcement from 5 July 2023, covers any computational process derived from “machine learning, statistical modeling, data analytics, or artificial intelligence” that issues a simplified output substantially assisting or replacing discretionary employment decision-making for hiring or promotion. It requires a bias audit within one year of use by an independent auditor with no employment by, financial interest in, or prior involvement with employer or vendor; calculation of selection or scoring rates and impact ratios across sex, race and ethnicity, and intersectional categories; publication of a summary on the employer’s website; and 10 business days’ notice to candidates. Each day of use in violation is a separate violation. An executive who introduces a screening or promotion tool has taken on a publication obligation, not just a procurement decision.
- The harassment standard is lower than the federal one, at any employer size. Executive Law section 296 expressly disclaims “severe or pervasive” and leaves an affirmative defence only where conduct amounts to no more than petty slights or trivial inconveniences. Section 292(5) covers “all employers within the state”. The state model policy required by Labor Law section 201-g must state that harassment is employee misconduct with sanctions against supervisors who knowingly allow it to continue. Complaints may be filed within three years under section 297(5), with remedies including punitive damages and civil fines up to $50,000, or $100,000 where conduct is willful, wanton or malicious.
- The city protects characteristics the state does not. The New York City Human Rights Law adds caregiver status, credit history, salary history inquiry, pre-employment marijuana testing, unemployment status, sexual and reproductive health decisions, and height and weight, generally at four or more persons – but reaching employers of any size for gender-based harassment under Administrative Code section 8-102. It is construed liberally in favour of plaintiffs under the Local Civil Rights Restoration Act, and section 8-502 allows punitive damages, injunctive relief and fees to a prevailing party, including a plaintiff whose litigation catalysed a policy change.
- And retaliation over an accommodation is now separately actionable. The Reasonable Accommodation Anti-Retaliation Act, Chapter 600 of 2025, amended Executive Law section 296 effective 5 December 2025 and applies to all employers. Alongside it, the New York City Fair Chance Act has reached current employees facing discipline since Local Law 4 of 2021, so a criminal-history-informed decision about someone already employed carries the same written-analysis discipline as a hiring decision.
