What New York requires of a training programme

  • Annual, interactive, at every employer. Labor Law section 201-g applies to every employer with no minimum headcount – state guidance is explicit that this includes a household employing one nanny or housekeeper. The statute provides that “such sexual harassment prevention training shall be provided to all employees on an annual basis”, and it must be interactive. The accompanying policy must meet or exceed the state model, last updated August 2024, containing examples of prohibited conduct, federal and state remedies, a standard complaint form, a timely and confidential investigation procedure, sanctions against supervisors who knowingly allow harassment, and an anti-retaliation statement. Policy and training material must be provided in writing in English and in each employee’s identified primary language, at time of hiring and at every annual training.
  • New York City adds content, records and a poster. Local Law 96 of 2018, effective 1 April 2019, requires annual interactive training at 15 or more employees, with independent contractors counting toward the 15 regardless of hours, for all employees including supervisory and managerial staff and interns. New hires are trained after 90 days where they work more than 80 hours in a calendar year. Required content covers the internal complaint process, external procedures with contact information, the prohibition on retaliation, bystander intervention, and the specific responsibilities of supervisory and managerial employees. Records including a signed employee acknowledgment are retained at least three years, the Commission notice is posted in English and Spanish, and the factsheet goes to every new employee within the first week.
  • Retail employers of ten owe a second annual programme. Labor Law section 27-e defines a retail employer as one “employing at least ten retail employees”, counted statewide after Chapter 72 of 2025, signed 14 February 2025. The employer adopts the Department of Labor model workplace violence prevention policy or an equivalent and distributes it at hire and annually, with training at hire and then annually at 50 or more retail employees or every two years below 50. From 1 January 2027, employers of 500 or more retail employees statewide must give every retail employee a silent response button, fixed, wearable or phone-based, with location tracking prohibited except when activated.
  • And you can no longer recoup the cost. The Trapped at Work Act, Labor Law Article 37 sections 1050 to 1055, effective 19 December 2025, declares employment promissory notes “unconscionable, against public policy, and unenforceable”. That reaches any instrument requiring a worker to repay a sum on leaving before a stated period, expressly including training-cost framing. Carve-outs exist for genuine cash advances that are not training, property sold or leased to the employee, educational sabbatical terms, and collectively bargained programmes. Certification and tuition clawbacks in New York offer letters need auditing now, not at renewal.
