What New York specifies about training

  • Annual, interactive, at every employer, in every primary language. Labor Law section 201-g provides that “such sexual harassment prevention training shall be provided to all employees on an annual basis” and requires it to be interactive. It applies to every employer with no minimum headcount. The policy and the material presented at training must be given in writing in English and in each employee’s identified primary language, at time of hiring and at every annual training; where the Commissioner publishes no template in a language, English suffices, and an employer is not penalised for errors in a Commissioner-supplied translation. The state model policy was last updated August 2024, and the Department of Labor must re-evaluate it every four years beginning 2022.
  • New York City specifies the content and the record. Local Law 96 of 2018, Administrative Code section 8-107(30), effective 1 April 2019, requires annual interactive training at 15 or more employeesindependent contractors count toward the 15 regardless of hours – for “all employees, including supervisory and managerial employees”, with “employee” expressly applying to interns. New hires are trained after 90 days where they work more than 80 hours in a calendar year. Required content covers sexual harassment as unlawful discrimination under local, state and federal law, a definition with examples, the internal complaint process, external procedures with contact information, the prohibition on retaliation, bystander intervention, and the specific responsibilities of supervisory and managerial employees. Records including a signed employee acknowledgment are retained at least three years.
  • Retail employers of ten owe a second annual programme. Labor Law section 27-e defines a retail employer as one “employing at least ten retail employees”, counted statewide since Chapter 72 of 2025, signed 14 February 2025. The Department of Labor model workplace violence prevention policy – or an equivalent – is distributed at hire and annually, with training at hire and then annually at 50 or more retail employees or every two years below 50. From 1 January 2027, employers of 500 or more retail employees statewide must provide a silent response button to every retail employee, with location tracking prohibited except when activated.
  • And training-cost recovery is no longer available. The Trapped at Work Act, Labor Law Article 37 sections 1050 to 1055, effective 19 December 2025, declares employment promissory notes “unconscionable, against public policy, and unenforceable”, expressly reaching instruments framed as training-cost repayment. Carve-outs cover genuine cash advances that are not training, property sold or leased to the employee, educational sabbatical terms and collectively bargained programmes. Certification sponsorships and tuition clawbacks in New York offer letters need auditing now.

We are not attorneys, and training is not legal advice. Investigations and disciplinary decisions belong with New York employment counsel.

Training capacity in the city

  • New York City employs 12,530 training and development specialists at an annual mean of $90,450 and 1,910 training and development managers at $204,015, against all occupations at $95,518 (New York State Department of Labor occupational wages, May 2025 base updated to Q1 2026; NYSDOL states these estimates are not produced nor reviewed by the Bureau of Labor Statistics). Long Island’s equivalents are 2,820 at $85,264 and 320 at $180,077.
  • Against the wider metro, delivery capacity is under-supplied. The New York-Newark-Jersey City MSA runs training and development specialists at a location quotient of 0.79 – about a fifth below national concentration – while training and development managers sit at 1.20 (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026). More people designing programmes than delivering them, in a state that mandates delivery annually for every employer.
  • And the audience is unusually varied. Manhattan’s 2,520,287 covered jobs span finance and insurance at 331,140 and an average annual pay of $454,761, information at 186,728 and $243,497, professional services at 370,094, educational services at 125,472 with a location quotient of 2.42, and accommodation and food services at 215,907 and $56,872 (BLS Quarterly Census of Employment and Wages, Q4 2025 and 2025 annual averages). The same annual training obligation covers a trading floor and a hotel kitchen.

How we deliver training for Manhattan employers

Exceptional HR Solutions has one physical location, in Melissa, Texas, and no Manhattan office, facilitators or venue. Programmes are delivered remotely and live rather than pre-recorded, which is what interactive has to mean and which works across sites and shifts. Two honest limits: if you want a facilitator in a room on Park Avenue for two days, we are not the right provider; and translation into a specific employee’s primary language is something we co-ordinate rather than perform. What we build is the curriculum that satisfies both the state and city content requirements, the annual schedule that actually fires, and a completion record that survives a three-year request.
