Where the New York thresholds actually sit
- Four employees: fair chance, salary ranges and the city human rights law. The New York City Fair Chance Act, Administrative Code section 8-107(11-a), applies at four or more employees in the city and protects applicants, employees, interns, freelancers and independent contractors. Local Law 32 of 2022, effective 1 November 2022, requires a minimum and a maximum in any advertisement for a job, promotion or transfer performed wholly or partly in the city – open-ended ranges such as “and up” are non-compliant – at the same four-employee threshold, or one or more domestic workers. State pay transparency at Labor Law section 194-b also starts at four, effective 17 September 2023, and additionally requires the job description if one exists. A city employer must satisfy both.
- One employee: paid family leave, harassment training, and gender-based harassment claims. New York Paid Family Leave covers most private employers with one or more employees and is fully funded by employee payroll contributions – 0.432 percent of gross wages in 2026 to an annual maximum of $411.91, providing 12 weeks at 67 percent of average weekly wage capped at $1,228.53. Labor Law section 201-g requires an annual interactive training and a written policy for every employer with no minimum headcount. And Administrative Code section 8-102 extends the city human rights law to employers with fewer than four persons for gender-based harassment claims.
- Fifteen and twenty: the city-specific add-ons. Local Law 96 of 2018 requires annual anti-sexual harassment training at 15 or more employees, with independent contractors counting toward the 15, training for new hires after 90 days where they work more than 80 hours in a calendar year, three years of records with a signed acknowledgment, a poster in English and Spanish, and a factsheet to every new employee within the first week. The Fair Workweek Law reaches retail employers with 20 or more employees across all city locations under common ownership, and fast food chains with 30 or more locations nationally – it is not a general-employer law.
- And two obligations arrived in December 2025 that no platform default covers. The Trapped at Work Act, new Labor Law Article 37 sections 1050 to 1055, effective 19 December 2025, declares employment promissory notes “unconscionable, against public policy, and unenforceable” – which ends standard training-cost repayment clauses in New York offer letters, with carve-outs for genuine cash advances, property sold or leased to the employee, educational sabbatical terms and collectively bargained programmes. Separately, Chapter 681 of 2025 bans requesting or using consumer credit history in hiring, promotion or terms of employment, effective 120 days after signing on 19 December 2025, subject to listed exemptions including bonded roles, signatory financial authority over $10,000 and positions with a high degree of public trust.
