What an outsourced function actually has to run in Brooklyn

  • Weekly pay for manual workers. Labor Law section 191(1)(a) requires that “a manual worker shall be paid weekly and not later than seven calendar days after the end of the week in which the wages are earned.” Semi-monthly payment is available only to large employers holding a Department of Labor authorization; non-profits may negotiate a schedule no less frequent than semi-monthly. The classification question – who is a manual worker – has to be settled deliberately in a workforce built around aides, attendants, drivers and kitchen staff. The 16 May 2025 amendment to section 198(1-a) caps a first frequency violation at up to 100 percent of the lost interest, but only where the employer paid on a regular payday no less frequently than semi-monthly; repeat violators face full liquidated damages. Whether section 191 carries a private right of action remains unsettled between the First and Second Departments.
  • Leave that accrues by the hour and cannot be forced into shifts. Labor Law section 196-b accrues at not less than one hour per 30 hours worked to 40 paid hours at five to 99 employees or 56 at 100 or more, carries over, and permits a minimum increment of no more than four hours. Balances must be produced within three business days of an oral or written request under section 196-b(11). In New York City, 32 hours of immediately-available unpaid protected time off have applied since 22 February 2026, granted on the first day of work and each calendar year, and not carried over. Twenty hours of paid prenatal personal leave apply at every size, in hourly increments.
  • Annual training and policy distribution, in the right languages. Labor Law section 201-g requires interactive annual training for every employer regardless of size, with the policy and material issued in English and each employee’s identified primary language at hire and at every annual training. New York City’s Local Law 96 adds annual training at 15 or more employees – contractors count – with three years of records and a signed acknowledgment, a poster in English and Spanish, and a factsheet to every new employee within the first week. For a workforce spread across sites and languages, distribution and evidence are the hard parts, not content.
  • And six years of records behind all of it. Labor Law section 195(4) requires payroll records “established, maintained and preserved for not less than six years”, with the signed hiring notice acknowledgment – in English and the employee’s primary language – kept the same six years under section 195(1). Wage statements must carry the full section 195(3) list plus, for non-exempt employees, the regular hourly rate, the overtime rate, the regular hours and the overtime hours. Failures run at $250 per work day to a $5,000 cap and $50 per work day to a further $5,000 under sections 198(1-d) and 198(1-b).
