PEO Alternatives for Growing Austin TX Companies

The reason growing companies sign PEO agreements is usually the thresholds they are about to cross. Two of those thresholds are decided by last year’s data and one counts plan participants rather than employees. Knowing which ones actually bind you is what makes the buy-versus-build decision answerable. We build the unbundled alternative remotely from Melissa, Texas.

Exceptional HR Solutions provides PEO alternatives for growing Austin TX companies that need scalable HR support without entering a Professional Employer Organization co-employment relationship. As organizations grow, HR complexity increases across hiring, compliance, benefits, and workforce management. Many high-growth companies seek alternatives that deliver structure and expertise while preserving operational control.

Exceptional HR Solutions partners with Austin-based companies experiencing growth to deliver customized HR solutions that match evolving business needs. These services provide the functional advantages of a PEO while allowing leadership teams to maintain ownership of culture, strategy, and employment decisions.

Why Growing Austin Companies Seek PEO Alternatives

Rapid growth introduces new challenges that often lead companies to consider PEO services. However, co-employment models can limit flexibility and introduce long-term constraints that do not align with scaling organizations. PEO alternatives offer growing companies:

  • Control over employment and HR strategy

  • Flexible service models that evolve with growth

  • Customized compliance and risk management support

  • Scalable benefits and HR administration solutions

  • Predictable costs without bundled services

Exceptional HR Solutions helps Austin companies assess current HR infrastructure, identify growth-related risks, and implement tailored solutions that support expansion without sacrificing control.

Scalable HR Services Without Co-Employment

Growing companies need HR services that expand alongside the business. Exceptional HR Solutions provides scalable HR consulting and administrative support that functions as an effective PEO alternative.

Services include:

  • HR strategy and workforce planning

  • Policy development and employee handbook creation

  • HR compliance assessments and ongoing advisory

  • Performance management system design

  • Payroll vendor coordination and process support

These services allow growing organizations to access experienced HR leadership without committing to co-employment or rigid service bundles.

Compliance and Risk Management for Expanding Teams

As headcount increases, compliance obligations become more complex. Wage and hour laws, employee classification, benefits regulations, and documentation requirements demand proactive oversight.

According to the U.S. Department of Labor, employers remain responsible for wage and hour compliance even when HR administration is outsourced.

The thresholds a growing Austin company is about to cross

  • COBRA, at 20 employees in the prior calendar year. Continuation premiums are chargeable at up to 102% of plan cost. Because it is counted on the previous year, a company that grew through 20 during one year picks the obligation up the following January – after the growth, not during it.
  • ACA applicable large employer status, at 50 full-time employees including full-time equivalents, on a prior-year look-back. Part-time hours aggregate, so a company with 42 full-time and 20 part-time staff can be an applicable large employer. And the count may not be yours alone: the IRS states that companies with a common owner, or otherwise related under section 414 of the Internal Revenue Code, are generally combined and treated as a single employer for this purpose (irs.gov, page reviewed 8 August 2026). For ERISA purposes, 26 U.S.C. 414(b) and (c) apply an 80% parent-subsidiary test and an 80%-controlling-interest-plus-50%-effective-control brother-sister test, and section 414(m) can reach an affiliated service group at as little as 10% of interests held by highly compensated employees.
  • Form 5500, at 100 plan participants – not 100 employees. A plan with fewer than 100 participants at the start of the plan year is a small plan. Defined contribution pension plans count participants with account balances at line 6g(1); all other plans, welfare included, use line 5. A small welfare plan is exempt if unfunded or fully insured and not subject to Form M-1 (29 C.F.R. 2520.104-20). Filing is due the last day of the seventh month after plan year end, extendable by two and a half months on Form 5558, with penalties of up to $2,739 per day under ERISA section 502(c)(2) and $250 per day up to $150,000 from the IRS.
  • Then the employment ladder Title VII and the ADA at 15 employees for 20 or more calendar weeks; the ADEA at 20; FMLA at 50 for 20 or more workweeks (29 C.F.R. 825.104(a)); EEO-1 and WARN at 100, with WARN counted by single site of employment and Texas having no mini-WARN statute of its own.
  • And locally, nothing to plan for. Texas Labor Code section 1.005, added by HB 2127 effective 1 September 2023, voids local ordinances regulating employment leave, hiring practices, breaks, employment benefits or scheduling practices. Growth in Austin crosses federal lines, not municipal ones.

We are not attorneys, actuaries or brokers. Aggregation determinations and filing positions belong with ERISA counsel and your recordkeeper.

Austin is a market of small establishments growing quickly

  • Travis County 51,464 establishments and 939,358 employees in the fourth quarter of 2025, with employment up 2.7% over the year and average weekly wages up 6.1% to $2,061. Williamson County: 15,949 establishments, 240,347 employees, up 1.5%, at $1,590. Hays County: 6,438 establishments, 101,609 employees, up 2.5%, at $1,134 (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026).
  • Across the metro 76,604 establishments and 1,316,516 employees, with employment up 2.5% against 0.2% nationally – roughly twelve times the national growth rate – and wages up 5.4% against 4.2%. That growth rate is the reason threshold crossings arrive faster here than a national planning template assumes.
  • One data limit worth stating: BLS suppresses the Austin MSA private-sector-only figures for this quarter, so there is no metro private-sector establishment or wage figure to publish. We use the county rows and the all-ownership metro row instead. Anyone quoting an Austin MSA private-sector average weekly wage for Q4 2025 is quoting something BLS did not release.
  • The outsourcing industry you would be buying into is contracting nationally. Professional employer organizations (NAICS 561330) comprised 18,714 establishments and 406,631 employees at $84,488 average annual pay, down 3.7% year over year, and HR consulting services (NAICS 541612) 90,136 employees, down 3.0% – against total private employment growth of 0.4% (BLS QCEW, 2025 annual averages, private ownership).

How the unbundled alternative works for a growing company

We are not a PEO, not a co-employer and not an employer of record; we hold no payroll funds and place no insurance. Exceptional HR Solutions has one physical location, in Melissa, Texas, and no Austin office or staff. Unbundling keeps your own EIN, carrier relationships and unemployment experience rating, and buys the HR capability separately. For a company growing at Austin’s rate the practical benefit is a threshold monitor that flags a crossing before it happens rather than a co-employment agreement renegotiated after it – and the practical cost is that the master medical plan is not part of the package.

Questions

Frequently asked questions

Which threshold usually arrives first?

Title VII and the ADA at 15 employees for 20 or more calendar weeks, then the ADEA and COBRA at 20. COBRA is counted on the prior calendar year, so it lands the January after the growth.

How is ACA large employer status calculated?

By a prior-year look-back at 50 full-time employees including full-time equivalents, so part-time hours aggregate. Related companies are generally combined under section 414 of the Internal Revenue Code.

What is the 100-participant threshold?

The Form 5500 small plan line, measured at the start of the plan year. Defined contribution pension plans count participants with account balances at line 6g(1); all other plans, including welfare plans, use line 5.

Can our related companies be combined?

Yes. 26 U.S.C. 414(b) and (c) apply an 80% parent-subsidiary test and an 80%-plus-50% brother-sister test, and section 414(m) can reach an affiliated service group at 10% of interests held by highly compensated employees.

How fast is Austin actually growing?

Metro employment rose 2.5% over the year to the fourth quarter of 2025 against 0.2% nationally, with wages up 5.4% against 4.2%, across 76,604 establishments and 1,316,516 employees.

Why do you not quote an Austin private-sector wage figure?

Because BLS suppressed it. The Austin MSA private-sector-only QCEW figures for the fourth quarter of 2025 are withheld for disclosure reasons, so we use county rows and the all-ownership metro row instead.

Do you become our employer of record?

No. We are not a PEO, not an employer of record and not a co-employer. We work from Melissa, Texas, and support Austin companies remotely as an outside HR function.
