What a distributed hiring process has to comply with
- Pay transparency: 17 states plus DC enacted, 16 plus DC in force. The enacted list is California, Colorado, Connecticut, Delaware (effective 26 September 2027), the District of Columbia, Hawaii, Illinois, Maine (effective 28 July 2026), Maryland, Massachusetts, Minnesota, Nevada, New Jersey, New York, Rhode Island, Vermont, Virginia (effective 1 July 2026) and Washington. Localities add Jersey City; Albany County, Ithaca, New York City and Westchester; Cincinnati, Cleveland and Toledo; and Columbus from 1 January 2027. Use the enumerated list rather than a headline count – the two major trackers we checked both print totals that contradict their own tables.
- Salary history restrictions: do not rely on a published count. The trackers disagree, and at least one miscategorises Illinois, which does have a private-employer ban at 820 ILCS 112/10(b-20), effective 29 September 2019. The defensible statement is that more than 20 states and localities restrict salary history inquiries, with Virginia the most recent, effective 1 July 2026. In practice most distributed employers stop asking everywhere rather than maintain a per-jurisdiction rule.
- The federal thresholds that govern the process itself. Title VII (42 U.S.C. 2000e(b)) and the ADA (42 U.S.C. 12111(5)(A)) apply at 15 employees for 20 or more calendar weeks, and the ADEA (29 U.S.C. 630(b)) at 20. Below those, a company is still bound by state law – and by the pay transparency and salary history rules above, most of which apply from the first employee in the jurisdiction.
- And who the employer is can be contested. The NLRB final rule at 91 Fed. Reg. 9707, published and effective 27 February 2026, reinstated the 2020 joint employer standard at 29 C.F.R. 103.40, requiring possession and exercise of substantial direct and immediate control. Where an investor or a staffing partner is actually running selection decisions, that is the test that applies.

- What that does to a recruiting strategy is push it away from compensation competition and toward everything else: scope, equity, decision rights, remote flexibility. Those are all things a structured process can articulate consistently and an ad hoc one cannot.
- The recruiting capability itself nationally there are 912,430 human resources specialists – the occupational category covering recruiters – at an annual mean of $81,990, and 220,660 human resources managers at $164,230 (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026). Temporary help services (NAICS 561320), which includes much of the contract recruiting market, employed 2,498,070 across 95,749 establishments at average annual pay of $49,725, down 3.7% year over year (BLS Quarterly Census of Employment and Wages, 2025 annual averages).
