What Palm Beach County can and cannot require
- Local benefit mandates are preempted. Fla. Stat. section 218.077(2)(a) bars any political subdivision from mandating a minimum wage other than the state or federal rate, or requiring employment benefits not otherwise required by state or federal law. Section 218.077(1)(d) defines employment benefits to include paid or unpaid days off for holidays, sick leave, vacation and personal necessity. There is no Palm Beach County or City of Boca Raton paid sick leave, PTO payout or predictive scheduling ordinance, and none can now be enacted. Sections 448.077 and 448.106 separately preempt local scheduling and heat exposure rules.
- The county living wage is narrow and dated. Palm Beach County Code ch. 2, Article IV, Division 3 applies to paratransit contracts and construction contracts over $100,000 that are not subject to Davis-Bacon – not to private employers generally, and not to ordinary county service contracts. Its base rate was $11.64 set in 2013, adjusted for CPI each 1 October. We do not publish the current rate, having not confirmed the 2026 figure from a primary source. Section 3 of ch. 2024-80 preserves such terms only in contracts entered into before 30 September 2026; after that date Fla. Stat. section 218.077(2)(b) and (c) bar the county from using its purchasing procedures to control contractor wages at all.
- Related companies are counted together for the ACA. The IRS states that companies with a common owner, or otherwise related under the rules of section 414 of the Internal Revenue Code, are generally combined and treated as a single employer for determining applicable large employer status (irs.gov, page reviewed 8 August 2026). The threshold is 50 full-time employees including full-time equivalents. In a county with a heavy concentration of holding-company and investment structures, two 30-person Boca entities under common ownership are very likely one applicable large employer. COBRA separately starts at 20 employees in the prior year, chargeable at up to 102% of plan cost.
- The one benefit Florida does mandate is state-level. Fla. Stat. section 741.313 requires employers with 50 or more employees to provide up to three working days of domestic violence leave per 12-month period to employees with at least three months of service, paid or unpaid at the employer’s discretion, after other accrued leave is exhausted unless waived. Section 218.077(3)(b) would allow a county to go further; only Miami-Dade has, so Palm Beach employers face the state rule alone.

- That is the design problem in one line: the county’s headline wage of $1,710 is 9.0% above national, but the three largest private sectors all sit below it. A benefits plan priced against the county average will be unaffordable for most of the people it covers.
- The contrast within the county is extreme. Finance and insurance paid $4,098 a week across 26,893 employees, and professional and technical services $2,936 across 57,844. A single Boca employer with both a professional services arm and a service or hospitality operation is running one plan across a threefold wage spread.
- Growth is where the benefit costs are.
