HR compliance in Texas: what Houston employers must get right
Texas adds little above the federal floor. No state paid sick leave, no pay transparency requirement, no salary history ban, no meal or rest break mandate, no state mini-WARN act, no mandatory harassment training for private employers. Four things do bite.
Sexual harassment liability starts at one employee. For sexual harassment claims Texas defines an employer as anyone employing one or more employees — not the fifteen-employee Title VII threshold — and the standard is failure to take immediate and appropriate corrective action. The filing window is 300 days, against 180 for other discrimination claims. (Texas Labor Code §§ 21.141–21.142, effective 1 September 2021.)
Final pay is six days after discharge, or the next regularly scheduled payday on resignation. (§ 61.014.) Payroll deductions require written authorization. (§ 61.018.) PTO and severance promised in a written policy become enforceable wages. (§ 61.001(7).)
Houston adds almost nothing on top. There is no city ordinance regulating private employment — the Equal Rights Ordinance is gone, and Chapter 17 of the city code is now Fair Housing. Health care and social assistance alone employs 405,400, roughly five and a half times the entire mining supersector. Growth is coming from elsewhere: construction up 5.2% and professional and business services up 3.1% over the year to July 2026, together supplying about 61% of the metro’s net job gain. Total nonfarm reached 3,497,700 in July 2026, up 50,300 or 1.5% — roughly five to six times the national growth rate of 0.20%. (BLS CES, July 2026, preliminary.)
