Benefits obligations in Texas: what Dallas employers must get right

Texas mandates remarkably little on benefits. There is no state paid sick leave law, no state family leave beyond federal FMLA, and no state requirement to offer health coverage. What Texas does regulate is what happens once you have promised something.

Your written policy converts benefits into wages. Under the Texas Payday Law, “wages” expressly includes vacation pay, holiday pay, sick leave pay, parental leave pay and severance pay owed to an employee under a written agreement or under a written policy of the employer. Texas does not require PTO payout on separation — but if your handbook says accrued PTO is paid out, that becomes an enforceable wage claim recoverable through the Texas Workforce Commission. (Texas Labor Code § 61.001(7).) This is the single most common benefits trap for employers moving into Texas from states where payout is mandatory.

And the Dallas sick leave ordinance is dead. The City of Dallas adopted a paid sick leave ordinance in April 2019. It was preliminarily enjoined on 30 March 2020 and permanently enjoined on 31 March 2021 as preempted by the Texas Minimum Wage Act and contrary to the Texas Constitution. The City states it will not enforce it, other than the anti-retaliation provision. (ESI/Employee Solutions, L.P. v. City of Dallas, No. 4:19-cv-00570-SDJ, E.D. Tex.) Note the sequence: it was struck down in 2021, more than two years before the state preemption statute in House Bill 2127 existed. Sources that credit HB 2127 with killing it have the history wrong.

Workers’ compensation is optional in Texas — the only state where that is true. Employers that decline coverage must post notice, tell new employees in writing, and file a notice of non-coverage with the Division of Workers’ Compensation between 1 February and 30 April each year.

What benefits administration costs in Dallas

Dallas-Fort Worth concentrates benefits expertise well above the national rate and pays below the national rate for it.

The metro employs 790 compensation and benefits managers at an annual mean wage of $154,860, against $162,640 nationally, with a location quotient of 1.32 — 32% more concentrated than the country as a whole. At specialist level there are 3,070 compensation, benefits and job analysis specialists at $83,510 against $84,330 nationally. (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026.)

The relevant comparison for most employers is not the manager salary but the alternative: 1,630 human resources assistants in the metro at an annual mean of $53,670, slightly above the national $52,250, with a location quotient of just 0.69. (BLS OEWS, May 2025.) Dallas is short of HR administrative capacity relative to its size, which is why so much benefits administration ends up on an office manager or a controller who was hired to do something else.

Scale is the other factor. Dallas County alone contains 82,560 establishments employing 1,853,927 people, with Tarrant County adding 49,779 establishments and Collin County 35,427. (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026.) The overwhelming majority are small enough that benefits administration is somebody’s second job. That is workable until an ACA filing deadline, a carrier audit or a mid-year plan change arrives at the same time as everything else.

How we support Dallas employers

Remote-first from Melissa, Texas — the same metro, the same state law, no travel premium. We handle enrollment cycles, carrier coordination, compliance filings and employee questions, and we review your handbook language against Texas Labor Code § 61.001(7) before it creates an obligation you did not intend. No Dallas office, and we do not claim one.

Frequently asked questions about benefits administration in Dallas

Does Dallas require employers to provide paid sick leave?

No. The City of Dallas paid sick leave ordinance was permanently enjoined on 31 March 2021 as preempted by the Texas Minimum Wage Act, and the City does not enforce it apart from its anti-retaliation provision. Texas has no statewide paid sick leave law either. (ESI/Employee Solutions, L.P. v. City of Dallas, No. 4:19-cv-00570-SDJ, E.D. Tex.)

Must a Texas employer pay out unused PTO when someone leaves?

Only if your own written policy or an agreement says so. Texas imposes no payout requirement — but once the promise is in writing, the unused balance becomes wages enforceable through the Texas Workforce Commission. (Texas Labor Code § 61.001(7).)

Is workers’ compensation insurance required for a Dallas business?

No. Texas is the only state where private employers may decline workers’ compensation coverage. Non-subscribers must post notice in the workplace, notify new employees in writing, and file annually with the Division of Workers’ Compensation between 1 February and 30 April.

What do benefits professionals earn in the Dallas market?

Compensation and benefits managers in Dallas-Fort Worth earn an annual mean of $154,860 and benefits specialists $83,510 — both below the national means of $162,640 and $84,330. (BLS Occupational Employment and Wage Statistics, May 2025 estimates.)

Why is it hard to hire benefits administration staff in Dallas?

The metro has a location quotient of 0.69 for human resources assistants, meaning the role is around 31% less concentrated in Dallas-Fort Worth than nationally, despite the metro’s size. (BLS OEWS, May 2025.) Administrative HR capacity is genuinely thin relative to the number of employers.

Did House Bill 2127 end the Dallas sick leave ordinance?

No, and the distinction matters if you are relying on a source that says otherwise. The ordinance was permanently enjoined in March 2021 on Texas Minimum Wage Act grounds. HB 2127, which added the broader preemption at Texas Labor Code § 1.005, took effect on 1 September 2023 — more than two years later.

Can we change benefits mid-year?

Generally yes, subject to your plan documents, carrier contracts and ERISA notice requirements. The Texas-specific caution is that any accrued benefit your written policy has already promised may already be wages, and reducing it retroactively is where claims arise.
