Why On-Demand HR Support Is Valuable
Many organizations need HR expertise at critical moments—during leadership transitions, policy interpretation, employee disputes, or compliance reviews—but cannot justify a full-time HR staff. On-demand HR support fills this gap by offering access to seasoned professionals focused on delivering immediate value.
According to SHRM, organizations that leverage external HR support for timely issue resolution are better positioned to prevent compliance violations, reduce turnover, and strengthen manager confidence. For Brooklyn NY employers operating in a complex regulatory landscape, on-demand HR support provides peace of mind and practical guidance when it matters most.
Exceptional HR Solutions ensures HR decisions are supported by experience, consistency, and strategic insight rather than guesswork.

The unscheduled events, and the clocks attached to them
- A complaint, measured against a standard lower than the federal one. Executive Law section 296 expressly disclaims the “severe or pervasive” test and leaves an employer an affirmative defense only where the conduct amounts to no more than petty slights or trivial inconveniences. Section 292(5) covers “all employers within the state” with no numeric minimum. The state model policy required by Labor Law section 201-g must contain a standard complaint form and a timely and confidential investigation procedure – so the process is meant to exist before it is needed. Complaints may be filed within three years under section 297(5); remedies include punitive damages and civil fines up to $50,000, or $100,000 where the conduct is willful, wanton or malicious.
- An accommodation request: five business days. Labor Law section 206-c requires a written lactation accommodation policy that specifies the request procedure and requires the employer to respond within five business days, with 30 minutes of paid break time per expression need for up to three years after childbirth. And since 5 December 2025, the Reasonable Accommodation Anti-Retaliation Act, Chapter 600 of 2025, has amended Executive Law section 296 for all employers – retaliation over a request is separately actionable from refusal of the request itself.
- A records or balance demand: three business days, and six years back. Labor Law section 196-b(11) requires the amounts of sick leave accrued and used to be supplied within three business days of an oral or written request. Section 195(4) requires payroll records “established, maintained and preserved for not less than six years”, and the signed hiring notice acknowledgment – in English and the employee’s identified primary language – for the same six years. Nothing about a demand gives you time to reconstruct what was never kept.
- A reduction: ninety days, before it happens. New York’s WARN Act applies at 50 or more employees excluding part-time, or 50 who work in the aggregate at least 2,000 hours a week, and requires notice “at least ninety days before the order takes effect” – 50 percent longer than federal WARN. A mass layoff is 25 employees and 33 percent of a single site in 30 days, or 250 regardless of percentage; a plant closing is 25 or more; a relocation is 50 miles or more. Notice goes to employees and representatives, the Department, local workforce investment boards, the chief elected official of the locality and school district, and local police, fire, emergency medical and ambulance providers. Section 860-h adds up to $500 per day of violation, waived if the section 860-g amounts are paid within three weeks. This is the one item on this page where calling late is worse than calling early.
We are not attorneys and this is not legal advice. A live investigation, a WARN determination or a termination decision belongs with New York employment counsel, and often immediately.
The Brooklyn context
- Brooklyn runs 75,628 establishments and 928,387 covered jobs at an average weekly wage of $1,242 – about 79 percent of the United States average of $1,569 – with employment up 1.8 percent over the year on the adjusted basis, the strongest of the New York counties measured (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026). Unemployment was 5.3 percent in June 2026, unchanged from a year earlier.
- Health care and social assistance is 45.6 percent of private employment – 365,311 people at an average annual pay of $46,456 and a location quotient of 2.68. Care settings generate accommodation requests, shift disputes and complaints at a rate office employers do not, which is why episodic support tends to be the realistic model rather than a retained function.
- If a problem escalates, the professional market is deep. The New York-Newark-Jersey City MSA employs 6,930 labor relations specialists at a location quotient of 1.75 – roughly 10.7 percent of the entire United States total – at an annual mean of $117,330, plus 23,380 compliance officers at $104,670 (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026).
How on-demand support works for Brooklyn employers
Exceptional HR Solutions has one physical location, in Melissa, Texas, and no Brooklyn office. On-demand means you can reach us for a specific question without a retainer, and we will give a straight answer or tell you it needs a lawyer. What it does not mean is a 24-hour line, or someone who can be at your site. We are also not investigators for contested allegations that need interviews conducted in person – for those you want an independent local investigator, and using the wrong one is worse than using none. The honest scope is guidance, documents and process design, delivered remotely and quickly.
Frequently asked questions

How quickly must we produce a leave balance?
Within three business days of an oral or written request, under Labor Law section 196-b(11).
What is the New York harassment standard?

How long do employees have to file?
Three years under Executive Law section 297(5). At the New York City Commission on Human Rights it is one year, or three for gender-based harassment, and a complainant cannot use both routes.

How far back do records have to go?
Not less than six years for payroll records under Labor Law section 195(4), including the signed hiring notice acknowledgment.
Do you conduct workplace investigations in Brooklyn?
Not contested ones requiring in-person interviews. We work remotely from our single location in Melissa, Texas, and for those matters we will point you to an independent local investigator.
