What California exposure actually looks like for an executive
- Harassment liability begins at one employee. FEHA generally applies at five or more persons under Government Code section 12926(d), but section 12940(j)(4)(A) provides that for harassment purposes an employer is “any person regularly employing one or more persons or regularly receiving the services of one or more persons providing services pursuant to a contract.” There is effectively no floor.
- Damages are uncapped and fees follow. Government Code section 12965(d) allows a court to grant “any relief a court is empowered to grant” – compensatory damages including emotional distress, punitive damages, injunctive relief, back and front pay – with no statutory cap. Section 12965(c)(6) allows a prevailing party reasonable attorney’s fees and costs including expert witness fees, though a prevailing defendant recovers only where the action was frivolous, unreasonable or groundless. Federal Title VII caps combined compensatory and punitive damages at $50,000 to $300,000 by employer size.
- And the exposure stays open for years. Section 12960(e)(5) allows three years from the unlawful practice to file with the Civil Rights Department – an intake form counts, with the verified complaint relating back, and there is an extension of up to 90 further days where the person first learned the facts in the 90 days after expiry. Section 12965(c)(1)(D) then allows one year from the right-to-sue notice to bring a civil action.
- The duty is affirmative, not passive. Section 12940(k) makes it unlawful to fail “to take all reasonable steps necessary to prevent discrimination and harassment from occurring.” Protected characteristics under section 12940(a) include reproductive health decisionmaking, gender identity, gender expression, genetic information, marital status and veteran or military status alongside the familiar categories.
- One 2025 constraint on how executives communicate. Labor Code section 1137, added by SB 399 effective 1 January 2025, prohibits adverse action against an employee who declines to attend an employer-sponsored meeting, or to receive communications, whose purpose is to convey the employer’s opinion on religious or political matters – defined broadly at section 1137(b)(3) to include the decision to join or support any political party or political or labour organisation – and requires employees working at the time who elect not to attend to continue to be paid. Its enforceability is contested in ongoing federal litigation; we do not state that it is or is not enjoined. Check the current status before relying on it either way.

- Labor relations specialists sit at a location quotient of 1.08 with 510 employed at $132,160 – respectable, but a fraction of San Francisco’s 2.02. San Jose has less of both the regulatory and the employment-dispute capability than the rest of coastal California, in a state with the broadest liability.
- Meanwhile it pays more than anywhere. All occupations average $119,230 against a national $69,770 – about 1.71 times national, the highest multiple in this project – and Santa Clara County’s average weekly wage was $4,542, 2.90 times the national $1,569 and fourth highest of the largest US counties (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026). Because uncapped compensatory awards and fee-shifting scale with the compensation of the people involved, executive conduct in this metro is expensive in a way it is not elsewhere.
- And the leadership layer is dense. Chief executives sit at a location quotient of 1.79 – though BLS suppressed the San Jose chief executive wage entirely and we do not estimate it – HR managers at 1.74 and $257,750, training and development managers at 2.52, compensation and benefits managers at 1.93. Many senior people, few compliance staff, unlimited damages.
