Two calendars, several cities, and California’s penalties
- The San Jose rate, and its neighbours. The San Jose Minimum Wage Ordinance, voter-approved 6 November 2012 (Ordinance 29829), sets $18.45 an hour from 1 January 2026, up from $17.95, for work performed within the City; the 1 January 2027 rate has not been published. The City’s Office of Equality Assurance is also contracted to enforce the minimum wage for Mountain View, Santa Clara, Palo Alto and Milpitas. California’s own floor is $16.90 from 1 January 2026 and $17.40 from 1 January 2027, indexed under Labor Code section 1182.12(c)(1) by the lesser of 3.5% and the CPI-W change, determined on or before 1 August each year.
- The exempt thresholds follow the state figure. Labor Code section 515(a) sets the white-collar exemption at two times the state minimum for full-time employment – $70,304 in 2026 and $72,384 in 2027. The computer software employee exemption under section 515.5 sits at $58.85 an hour, $10,214.44 a month, $122,573.13 a year from 1 January 2026, which in this metro is not a marginal category.
- Final pay is immediate, and late costs thirty days. Labor Code section 201(a) makes wages “due and payable immediately” on discharge including layoff; section 202(a) gives 72 hours where an employee quits without notice, or payment at the time of quitting where 72 hours’ notice was given. Section 203(a) continues the employee’s wages as a penalty for a willful failure, capped at 30 days – a large number against a metro all-occupations mean of $119,230.
- Nine wage statement items, and a $4,000 private ceiling. Labor Code section 226(a) requires gross wages, total hours worked, piece-rate detail where applicable, all deductions, net wages, inclusive pay period dates, employee name with only the last four digits of the social security number, the legal entity name and address, and all applicable hourly rates with corresponding hours at each rate. Records kept three years; production within 21 calendar days under section 226(c) with a $750 penalty under section 226(f). Section 226(e)(1) gives the greater of actual damages or $50 initially and $100 per subsequent violation, capped at $4,000. Labor Commissioner citations under section 226.3 run to $250 per employee initially and $1,000 subsequently.
- And PAGA rewards auditing. For actions brought on or after 19 June 2024, section 2699(f)(2)(A) sets a default of $100 per aggrieved employee per pay period, $25 for derivative wage-statement violations the employee could promptly and easily resolve from the statement alone, and $50 for isolated non-recurring events. Section 2699(g)(1) caps recovery at 15% where all reasonable steps were taken before notice and section 2699(h)(1) at 30% within 60 days after, with periodic payroll audits named as one of those steps.

- San Diego, by contrast, runs payroll clerks at 1.21 and HR assistants at 1.39 at roughly three-quarters of the San Jose rate. The South Bay does not staff the transactional layer, and it pays a premium when it does.
- The wage base makes every error larger. Santa Clara County averaged $4,542 a week in the fourth quarter of 2025 – 2.90 times the national $1,569 and fourth highest of the largest US counties – across 90,346 establishments and 1,133,029 employees (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026). Because waiting time penalties run at the employee’s own rate for up to 30 days, a single missed final payment here is a materially bigger number than the same error elsewhere.
