HR compliance in Texas: what San Antonio employers must get right

San Antonio has no ordinance binding private employers. The city’s Sick and Safe Leave Ordinance was enjoined in 2019 and never took effect for any private employer; the Fourth Court of Appeals affirmed the injunction on 10 March 2021, holding the paid sick leave provision established a minimum wage inconsistent with the Texas Minimum Wage Act and contrary to the Texas Constitution, with mandate issued 19 May 2021. (Washington v. Associated Builders & Contractors of South Texas, Inc., No. 04-20-00004-CV, Tex. App.—San Antonio.) Texas Labor Code § 1.005 has since preempted municipal employment regulation generally.

What remains is federal law plus four Texas rules.

Sexual harassment liability starts at one employee, on a failure-to-take-immediate-and-appropriate-corrective-action standard, with a 300-day filing window against 180 days for other discrimination claims. (Texas Labor Code §§ 21.141–21.142.) Final pay is six days after discharge. (§ 61.014.) Deductions need written authorization. (§ 61.018.) Written PTO and severance policies become enforceable wages. (§ 61.001(7).)

Texas requires no paid sick leave, no pay transparency, no salary history ban, no meal or rest breaks, no mini-WARN and no harassment training for private employers. Workers’ compensation is optional.

San Antonio’s labor market and what it means for hiring

San Antonio is the lowest-paying large metro in Texas, and the shape of that discount is unusual.

Across all occupations the metro averages $61,140 a year against a national $69,770 — 12% below. Compare Austin at $74,580, Dallas-Fort Worth at $70,630 and Houston at $67,610. (BLS Occupational Employment and Wage Statistics, May 2025 estimates, released 15 May 2026.) San Antonio is 18% below Austin on the same measure.

Yet chief executives here earn an annual mean of $311,910 against $269,630 nationally — 15.7% above, and it is the only occupation in the set that pays above the national rate. It also carries the lowest location quotient in the set at 0.38, meaning executive-titled roles are less than half as common here as nationally. (BLS OEWS, May 2025.)

Few executives, paid well, in a low-wage metro. That is the profile of an owner-operator market: businesses run by the person who founded them, without the management layer that would normally absorb HR.

The HR bench is present but modest. 1,650 human resources managers at a location quotient of 1.03 — national average concentration — at an annual mean of $142,590 against $164,230 nationally, a 13% discount. HR specialists number 7,570 at a location quotient of 1.14. (BLS OEWS, May 2025.)

County wages set the floor for everything else: Bexar County averages $1,341 per week against a national $1,569 — 14.5% below, roughly $11,900 a year per worker — across 44,913 establishments and 940,823 jobs. That is the lowest of the six large Texas urban counties: Travis runs $2,061, Dallas $1,823, Harris $1,803, Collin $1,786, Tarrant $1,493. Bexar’s wage growth of 3.3% is also the slowest of the six, so the gap is widening rather than closing. (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026.)

The metro is still outgrowing the country on payrolls — 1,192,200 nonfarm jobs in July 2026, up 0.9% against a national 0.2% — with unemployment at 4.8% in June 2026, the most recent month published, up from 4.0% a year earlier. (BLS Current Employment Statistics and Local Area Unemployment Statistics, preliminary, not seasonally adjusted.)

Frequently asked questions about fractional HR in San Antonio

Does San Antonio have a paid sick leave requirement?

No. The Sick and Safe Leave Ordinance was enjoined in 2019 and never took effect. The Fourth Court of Appeals affirmed the injunction on 10 March 2021 and mandate issued 19 May 2021. Texas has no statewide requirement either.

What does an HR manager cost in San Antonio?

An annual mean of $142,590 across 1,650 roles, against a national mean of $164,230 — a 13% discount. (BLS OEWS, May 2025 estimates.)

How do San Antonio wages compare with other Texas metros?

San Antonio averages $61,140 across all occupations against Austin’s $74,580, Dallas-Fort Worth’s $70,630 and Houston’s $67,610. It is the lowest-paying of the four large Texas metros. (BLS OEWS, May 2025.)

Chief executives earn $311,910 against $269,630 nationally, and it is the only occupation in the metro paying above national — while carrying the lowest location quotient in the set at 0.38. Few executive roles, well compensated, in an owner-operator market.

How quickly must a Texas employer issue final pay?

Six days after discharge; the next regularly scheduled payday on resignation. It cannot be held for unreturned property. (Texas Labor Code § 61.014.)

Does Texas require harassment training?

Not for private employers. But liability begins at one employee and turns on whether you took immediate and appropriate corrective action. (§§ 21.141–21.142.)

Is Bexar County wage growth catching up with the rest of Texas?

No. Bexar’s average weekly wage rose 3.3% over the year against Travis at 6.1%, Harris 4.7% and Dallas 4.1%. The gap with other Texas metros is widening. (BLS QCEW, Q4 2025.)
