The Florida answers that surprise people

  • No final pay deadline. Florida has no statute setting a time limit for paying final wages to a departing private sector employee, and no distinction between quitting and being discharged. The absence holds across the whole of Fla. Stat. ch. 448 Part I, sections 448.01 to 448.111, and Fla. Stat. ch. 532. The default is the regular payday for the pay period in which the work was performed, under the federal Fair Labor Standards Act prompt payment principle.
  • No pay frequency requirement, and in this county no local backstop. Florida does not require weekly, biweekly or any other cycle. Broward, Miami-Dade and Hillsborough counties each impose a 14-day payment presumption through a wage theft ordinance; Palm Beach County has no wage theft ordinance – it funds the Legal Aid Society Wage Dispute Project under Resolution R-2012-1857, which is a legal services contract rather than a regulation. In Boca Raton nothing fills the gap, so your written policy is genuinely the standard you will be measured against.
  • No PTO or vacation payout mandate. Accrued paid time off is not defined as wages by Florida statute, so payout on separation is governed entirely by your own policy or contract. No Florida local government can change that: Fla. Stat. section 218.077(1)(d) puts paid and unpaid days off for holidays, sick leave, vacation and personal necessity inside the employment benefits political subdivisions may not require.
  • No adult meal or rest breaks – the only Florida break law covers minors. Fla. Stat. section 450.081(4) requires a 30-minute meal interval for minors aged 15 and under after four continuous hours of work, and the same for 16 and 17 year olds working eight or more hours in a day. There is no adult break requirement in Florida of any kind. Supervisors arriving from a state that has one apply the wrong rule in both directions, which is the single most common quick question we get from hospitality and retail employers in this county.
  • And one obligation that does exist and is easy to miss. Fla. Stat. section 509.214, created by ch. 2025-113 and effective 1 July 2026, requires a public food service establishment charging an automatic operations charge to disclose the amount or percentage and its purpose in a prescribed font, and to itemize gratuity, operations charge and sales tax separately on bills and receipts.

We are not attorneys. A question that is really about whether a specific termination or deduction was lawful goes to Florida employment counsel, and we will tell you when you have crossed that line.

Who is asking these questions in Palm Beach County

  • Retail, hospitality and health care dominate the headcount. Palm Beach County employed 104,511 in health care and social assistance, 80,432 in retail and 75,102 in accommodation and food services in the fourth quarter of 2025, out of 682,552 total (BLS Quarterly Census of Employment and Wages, Q4 2025, released 2 June 2026). Those are the sectors that generate break questions, tip questions, scheduling questions and final pay questions, and they are the ones with no HR function.
  • Leisure and hospitality is the division’s flat spot. The West Palm Beach-Boca Raton-Delray Beach division held 93,000 leisure and hospitality jobs in July 2026, down 0.11% over the year – essentially unchanged – against education and health services up 2.26% to 122,400 and financial activities down 1.88% to 47,000 (FloridaCommerce preliminary July 2026 figures, released 21 August 2026).
  • The county pays well on average and not in these sectors. Palm Beach’s average weekly wage was $1,710, 9.0% above the national $1,569 and the highest of Florida’s four large counties, with wages up 7.5% over the year. Health care, its largest private sector, averaged $1,402. The headline figure describes the investment and professional services economy, not the workforce asking most of the questions.
  • Across very small employers 71,508 establishments and 682,552 employees, roughly 9.5 employees each as a derived average – the smallest of the four counties.

How on-demand support works from Melissa, Texas

Exceptional HR Solutions has one physical location, in Melissa, Texas, and no Boca Raton office or Palm Beach County staff. On-demand support means a named practitioner you can reach when a question arrives, with answers that come back sourced rather than as opinion, and a clear line drawn when something needs counsel. It does not mean somebody drives over, and it does not mean we own your HR roadmap – that is what a fractional arrangement is for.

Questions

Frequently asked questions

How long does a Boca Raton employer have to issue a final paycheck?

Florida sets no deadline, and unlike Broward or Hillsborough, Palm Beach County provides no 14-day presumption either. The default is the regular payday for the pay period in which the work was performed. Your written policy is the operative standard.

Do Florida employers have to give meal or rest breaks?

Not to adults. Fla. Stat. section 450.081(4) requires a 30-minute meal interval only for minors: those aged 15 and under after four continuous hours, and 16 and 17 year olds working eight or more hours in a day. There is no adult break requirement in Florida.

Do we have to pay out unused vacation in Florida?

Not unless your policy or contract says so. Accrued vacation and PTO are not defined as wages by statute, and Fla. Stat. section 218.077(1)(d) prevents any Florida county or city from imposing a payout requirement.

How often must we run payroll?

As often as your own policy states. Florida has no pay frequency requirement for private employers, and Palm Beach County adds none.

What is an operations charge and when did the rule change?

Fla. Stat. section 509.214, created by ch. 2025-113 and effective 1 July 2026, requires a public food service establishment charging an automatic operations charge to disclose its amount or percentage and purpose in a prescribed font, and to itemize gratuity, operations charge and sales tax separately on bills and receipts.

What is the difference between on-demand support and fractional HR?

On-demand answers questions as they arrive. Fractional HR owns the roadmap, sets priorities and carries decisions on a standing cadence. Employers usually move from the first to the second when the questions stop being one-offs.
