Sexual harassment liability applies from your first employee. Texas defines an employer, for sexual harassment claims, as anyone who employs one or more employees. The standard is failure to take immediate and appropriate corrective action, and the filing window is 300 days. (Texas Labor Code §§ 21.141–21.142, effective 1 September 2021.) General discrimination coverage under Chapter 21 does start at fifteen employees, and FMLA at fifty. (§ 21.002(8).) But the rules that generate day-to-day claims have no threshold at all:

Final pay within six days of discharge, or the next regular payday on resignation — and the check cannot be held because a laptop has not come back. (§ 61.014.) No payroll deduction without written authorization. (§ 61.018.) Any PTO, holiday or severance pay promised in a written policy becomes enforceable wages. (§ 61.001(7).) New hires reported within 20 calendar days. And unemployment tax registration within 10 days of paying $1,500 in gross wages in a calendar quarter or employing someone in 20 different weeks of a year, on a taxable wage base of the first $9,000 per employee, at a 2.70% new employer rate for 2026.
